【摘要】： 我國已于2001年11月10日加入了WTO。對我國而言，加入WTO后機(jī)遇與挑戰(zhàn)并存，很多行業(yè)和部門將面臨著國門驟開的沖擊，，其中農(nóng)業(yè)部門將是受到?jīng)_擊最嚴(yán)重的部門之一。如何在WTO農(nóng)業(yè)規(guī)則的框架下，加快農(nóng)業(yè)現(xiàn)代化的步伐，增強(qiáng)我國農(nóng)業(yè)的市場競爭力成為當(dāng)今的一項(xiàng)重要課題。創(chuàng)新現(xiàn)代化農(nóng)業(yè)生產(chǎn)制度是農(nóng)業(yè)現(xiàn)代化的根本，好的制度安排不僅能使現(xiàn)有資源的潛力得到最大的發(fā)揮，而且還具有吸納增量資源的功能，我國的農(nóng)業(yè)體制改革已證明了這一點(diǎn)。在各項(xiàng)農(nóng)業(yè)生產(chǎn)制度創(chuàng)新中，最重要的是農(nóng)用土地制度的創(chuàng)新。我國目前廣泛實(shí)行的土地承包制度隨著時(shí)間的推移，制度本身的弊端日益顯露。本文擬在WTO農(nóng)業(yè)協(xié)議的框架內(nèi)考察我國現(xiàn)行農(nóng)用土地法律制度的得與失，通過建構(gòu)適應(yīng)促進(jìn)農(nóng)民農(nóng)業(yè)向現(xiàn)代化農(nóng)業(yè)轉(zhuǎn)變的農(nóng)用土地法律制度，為我國農(nóng)業(yè)迎接WTO的沖擊提供制度上的準(zhǔn)備和對策。
[Abstract]:China joined WTO on November 10, 2001. For China, opportunities and challenges coexist after China's entry into WTO, and many industries and departments will face the shock of sudden opening of the country's borders, among which the agricultural sector will be one of the most severely affected sectors. How to quicken the pace of agricultural modernization and strengthen the market competitiveness of Chinese agriculture under the framework of WTO agricultural rules has become an important subject. Innovating modern agricultural production system is the foundation of agricultural modernization. Good institutional arrangement can not only maximize the potential of existing resources, but also absorb incremental resources. China's reform of the agricultural system has proved this point. In the innovation of agricultural production system, the most important is the innovation of agricultural land system. With the passage of time, the defects of the land contract system are becoming more and more obvious. This paper intends to investigate the gains and losses of the current agricultural land legal system in China within the framework of the WTO Agreement on Agriculture, and to construct an agricultural land legal system adapted to the transformation of farmers' agriculture to modern agriculture. For our agriculture to meet the impact of WTO to provide institutional preparation and countermeasures.
