【摘要】： 中國水路運(yùn)輸產(chǎn)業(yè)雖然在改革開放以來取得了可喜成績，但水路運(yùn)輸法制建設(shè)卻一直處于相對落后狀態(tài)，無法適時(shí)調(diào)整水路運(yùn)輸中的各種民事法律活動(dòng)。如何完善我國水路運(yùn)輸民事法律體系一直是海商法研究中的薄弱環(huán)節(jié)，，而完善這一法律體系在現(xiàn)階段的首要任務(wù)是要科學(xué)地確定一套完善我國水路運(yùn)輸民事法律體系的方案。 本文圍繞這一研究、寫作目的，以《海商法》為基點(diǎn)，從研究我國水路運(yùn)輸現(xiàn)行民事法律體系的結(jié)構(gòu)出發(fā)，在剖析現(xiàn)行法律體系弊端的基礎(chǔ)上分析完善該法律體系的必要性；然后運(yùn)用對該法律體系中的主要法律制度與《海商法》相應(yīng)制度進(jìn)行比較研究的方法，提出我國水路運(yùn)輸民商法律體系中應(yīng)當(dāng)建立的主要法律制度，進(jìn)而在構(gòu)建中國水上運(yùn)輸完整統(tǒng)一的民商法律體系的框架下，提出完善我國水路運(yùn)輸民商法律體系的五種可行性方案：最后結(jié)合立法學(xué)原理，選出最優(yōu)方案。
[Abstract]:Although China's waterway transport industry has made gratifying achievements since the reform and opening up, the legal construction of waterway transportation has been in a relatively backward state, and it is unable to adjust all kinds of civil legal activities in waterway transportation timely. How to perfect the civil legal system of waterway transportation in our country has always been a weak link in the study of maritime law, and the primary task of perfecting this legal system at the present stage is to scientifically determine a plan to perfect the civil legal system of waterway transportation in our country. This paper focuses on this research, writing purpose, taking Maritime Law as the basic point, starting from studying the structure of the current civil legal system of waterway transportation in our country, analyzing the necessity of perfecting this legal system on the basis of analyzing the malpractice of the current legal system; Then using the method of comparing the main legal system of this legal system with the corresponding system of "Maritime Law", this paper puts forward the main legal system that should be established in the civil and commercial legal system of waterway transportation in our country. Then, under the framework of constructing a complete and unified civil and commercial legal system of China's waterway transportation, five feasible schemes are put forward to perfect the civil and commercial legal system of waterway transportation in China: finally, combining with the principle of legislation, the best scheme is selected.
