【摘要】:要想改變現(xiàn)狀,首先必須尋找產(chǎn)生現(xiàn)狀的根源,即問(wèn)題所在,只有充分認(rèn)識(shí)問(wèn)題才能找到合適的對(duì)策,從而改變現(xiàn)狀。目前,我國(guó)沿海內(nèi)河航運(yùn)業(yè)正處于大力發(fā)展時(shí)期,而作為航運(yùn)業(yè)保障的沿海內(nèi)河船舶保險(xiǎn)卻因?yàn)橘r付率居高不下而經(jīng)營(yíng)艱難,這種情況不利于國(guó)內(nèi)航運(yùn)業(yè)的發(fā)展。而對(duì)于沿海內(nèi)河船舶保險(xiǎn)賠付率高的原因及解決方法,目前國(guó)內(nèi)仍沒(méi)有學(xué)術(shù)著作對(duì)其進(jìn)行全面論述。針對(duì)目前情況,本文以沿海內(nèi)河船舶保險(xiǎn)存在的問(wèn)題及對(duì)策為主線,結(jié)合我國(guó)《海商法》及中國(guó)人民銀行制定的《沿海內(nèi)河船舶保險(xiǎn)條款》(以下簡(jiǎn)稱《96條款》及《沿海內(nèi)河船舶保險(xiǎn)條款解釋》(以下簡(jiǎn)稱《96條款解釋》),并參照目前沿海內(nèi)河船舶保險(xiǎn)習(xí)慣作法,采用比較、歸納的方法,對(duì)沿海內(nèi)河船舶保險(xiǎn)存在的問(wèn)題及對(duì)策進(jìn)行了全面的研究。以期達(dá)到拋磚引玉,為我國(guó)沿海內(nèi)河船舶保險(xiǎn)的發(fā)展貢獻(xiàn)微薄之力。 本文以沿海內(nèi)河船舶保險(xiǎn)存在的問(wèn)題與對(duì)策為研究對(duì)象,主要分析和討論了以下四個(gè)問(wèn)題:一、沿海內(nèi)河船舶保險(xiǎn)概述。從沿海內(nèi)河船舶保險(xiǎn)主體、保險(xiǎn)條款和沿海內(nèi)河船舶保險(xiǎn)現(xiàn)狀三方面,對(duì)沿海內(nèi)河船舶保險(xiǎn)作簡(jiǎn)單介紹,明確了目前沿海內(nèi)河船舶保險(xiǎn)存在賠付率居高不下,經(jīng)營(yíng)艱難的現(xiàn)狀。二、沿海內(nèi)河船舶保險(xiǎn)存在的問(wèn)題及對(duì)策。論述了規(guī)范國(guó)內(nèi)船舶保險(xiǎn)合同的法律及《96條款》、承保、理賠、保險(xiǎn)公估及其他方面存在問(wèn)題,導(dǎo)致賠付率居高不下,國(guó)內(nèi)船舶保險(xiǎn)業(yè)經(jīng)營(yíng)艱難,并對(duì)目前存在的問(wèn)題提出對(duì)策。三、沿海內(nèi)河船舶保險(xiǎn)合同的法律適用。主要對(duì)采用《96條款》的海船船舶保險(xiǎn)合同和內(nèi)河船舶保險(xiǎn)合同在適用法律方面的不同進(jìn)行論述,以解決沿海內(nèi)河船舶保險(xiǎn)合同正確適用法律問(wèn)題。四、《96條款》存在的問(wèn)題及對(duì)策。根據(jù)《96條款解釋》、保險(xiǎn)的習(xí)慣作法及司法實(shí)踐,對(duì)《96條款》進(jìn)行評(píng)析,,指出《96條款》存在的問(wèn)題并提出修改建議,明確了《96條款解釋》沒(méi)經(jīng)保險(xiǎn)人和被保險(xiǎn)人約定采用,對(duì)被保險(xiǎn)人沒(méi)有約束力。在對(duì)《96條款》評(píng)析過(guò)程中,以案例、專家學(xué)者的觀點(diǎn)和海上保險(xiǎn)習(xí)慣做法為依據(jù),對(duì)保險(xiǎn)人的承保范圍、除外責(zé)任、保證條款、被保險(xiǎn)人的義務(wù)等方面進(jìn)行了詳細(xì)論述,以使保險(xiǎn)人和被保險(xiǎn)人在發(fā)生保險(xiǎn)事故時(shí)能正確處理,降低賠付率,促進(jìn)沿海內(nèi)河船舶保險(xiǎn)的迅速發(fā)展,達(dá)到雙贏的目的。 本文根據(jù)所討論的問(wèn)題,在結(jié)構(gòu)上共分成五章。第一章至第四章主要是對(duì)所
[Abstract]:If we want to change the present situation, we must first look for the source of the present situation, that is, the problem. Only by fully understanding the problem can we find the appropriate countermeasures to change the present situation. At present, China's coastal inland river shipping industry is in a period of vigorous development, but the coastal river shipping insurance, as a guarantee of the shipping industry, is difficult to operate because of the high compensation rate, which is not conducive to the development of domestic shipping industry. However, there are still no academic works to discuss the reasons and solutions of the high indemnity rate of coastal inland river ships. In view of the current situation, this paper takes the existing problems and countermeasures of marine insurance in coastal inland rivers as the main line. Combined with the Maritime Law of China and the provisions of Coastal Inland River Shipping Insurance formulated by the people's Bank of China (hereinafter referred to as < 96 clause) and the interpretation of coastal inland river ship insurance clause (hereinafter referred to as < 96 clause interpretation), and referring to the present situation along the river. The usual practice of sea inland river ship insurance, By using the method of comparison and induction, the problems and countermeasures of marine insurance in coastal inland rivers are studied comprehensively. In order to achieve the development of China's coastal inland river shipping insurance contribution meagre contribution. This paper takes the problems and countermeasures of coastal inland river ship insurance as the research object, mainly analyzes and discusses the following four problems: first, the outline of coastal inland river ship insurance. Second, the existing problems and countermeasures of the coastal inland river ship insurance. This paper discusses the problems existing in the law and < 96 clause of the domestic ship insurance contract, including underwriting, claim settlement, insurance evaluation and other aspects, which lead to the high compensation rate and the difficult operation of the domestic ship insurance industry, and puts forward the countermeasures to the existing problems. Third, the law application of the coastal inland river ship insurance contract. This paper mainly discusses the differences in the applicable law between the marine ship insurance contract and the inland ship insurance contract adopted < 96 clause, in order to solve the problem of applying the law correctly to the coastal inland river ship insurance contract. Fourth, < 96 clause > existing problems and countermeasures. According to < 96 clause interpretation >, insurance practice and judicial practice, this paper analyzes < 96 clause >, points out the problems existing in < 96 clause > and puts forward some suggestions for amendment. It is clear that < 96 clause interpretation has not been adopted by the insurer and the insured. It is not binding on the insured. In the course of analyzing < 96 clause, based on the case, the viewpoint of experts and scholars and the usual practice of marine insurance, the paper discusses in detail the insurer's scope of insurance, exclusions, warranty clauses, and the obligations of the insured, etc. So that the insurer and the insured can deal with the insurance accident correctly, reduce the odds of payment, promote the rapid development of the coastal inland river ship insurance, and achieve the goal of win-win.
