對完善我國船舶油污損害賠償法律機制的探討

【摘要】:我國是一個航運大國和海洋大國,擁有遼闊的海域和豐富的海洋資源,具有 多樣的海洋生態(tài)系統(tǒng)和生物物種,然而由于經濟發(fā)展帶來的各種污染,我國海洋生 態(tài)環(huán)境保護形勢不容樂觀。海上運輸特別是海上石油運輸是造成污染的主要原因 之一。2003年,我國石油進口列世界第二位。隨著石油運輸量的不斷上升、油輪 的大型化以及海上運輸業(yè)的發(fā)展,因船舶油污造成海域污染的風險不斷增大。船 舶油污損害賠償法律制度作為調整船舶關系的法律,兼有侵權行為法、環(huán)境資源 法和海商法等多種法律特點,具有很強的國際性、專業(yè)性和特殊性。由于我國目 前沒有專門的船舶油污損害賠償立法,使該領域的法律適用存在不統(tǒng)一和分歧, 不利于船舶油污事故的預防和救濟,一旦發(fā)生大規(guī)模的油污事件,法律不健全的 問題將更為突出。在現(xiàn)有船舶油污損害賠償法律體制下,石油業(yè)貨主不參與油污 造成的損害賠償?shù)姆謸?不能充分體現(xiàn)公正衡平的立法要求,也不能充分保障對 油污受害方的賠償和清污工作的開展,不利于海洋生態(tài)環(huán)境的保護和可持續(xù)發(fā)展。 因此,完善我國船舶污染損害賠償法律制度已成為當務之急。 本文將主要闡述船舶油污法律制度中的損害與賠償問題,包括如何確定油污 損害賠償民事責任的制度以及完善油污損害賠償?shù)牧⒎ńㄗh。文章分析了我國現(xiàn) 行船舶油污損害賠償法律體系及特點、有關船舶油污損害賠償領域的國際公約和 具有代表性的其他國家的立法方式,剖析了船舶油污這一海上環(huán)境侵權行為的責 任與賠償制度的特點,并結合我國國情,根據(jù)研究結果提出相應的立法建議。

Therefore, it is urgent to perfect the legal system of ship pollution compensation in our country. This paper will mainly expound the damage and compensation in the legal system of ship oil pollution, including how to determine the oil pollution. The system of civil liability for damages and the legislative proposals for perfecting the compensation for oil pollution damage. This paper analyzes the present situation in China. The legal system and characteristics of compensation for oil pollution damage from ships, international conventions and regulations in the field of compensation for oil pollution damage from ships, and The legislative methods of representative other countries are analyzed, and the liability of oil pollution of ships as an act of infringement of marine environment is analyzed. According to the characteristics of Ren and compensation system and the situation of our country, this paper puts forward corresponding legislative suggestions according to the research results.
