【摘要】： 我國的擔(dān)保法律體系中有一種非常特殊的抵押制度——船舶抵押制度,它是一種以船舶作為抵押物的擔(dān)保制度,因此,該制度可以適用《中華人民共和國海商法》和《中華人民共和國擔(dān)保法》的規(guī)定,但是,令人遺憾的是,盡管是同時受到兩部法律的調(diào)整,但是,船舶抵押權(quán)在司法實踐上卻仍然存在不少的問題和爭議。產(chǎn)生這些問題的原因在于這兩部法律對于船舶抵押的規(guī)定相對較少,而且這些規(guī)定本身還存在著一些紕漏以及不明確之處,甚至在某些地方這兩部法律的規(guī)定存還存在著相互矛盾,且制定法律時的理論觀點和如今有所不同。在航運事業(yè)突飛猛進的今天,如果不能及時協(xié)調(diào)或者解決這些問題的話,我國航運事業(yè)的進一步發(fā)展必將被這些問題直接或間接地阻礙。 2007年10月1日正式實施的《中華人民共和國物權(quán)法》對我國擔(dān)保法律制度進行了修補和完善,在這樣的背景下,如何順應(yīng)形勢,完善我國的船舶抵押制度就顯得十分必要——這也成為了本文的主要創(chuàng)作目的。 本文共分為三部分,從法理學(xué)的基本理論和新立法的精神出發(fā),擺事實,講道理,舉例子,不僅論述了物權(quán)法對建立我國船舶浮動抵押制度及船舶抵押登記制度的影響,而且論述了物權(quán)法對船舶抵押中諸如“共有船舶如何設(shè)定抵押”等其它一些問題的影響。 文章通過上述研究,得出了以下結(jié)論:我國可以從抵押權(quán)的主體、客體及實現(xiàn)方式幾個方面出發(fā)建立我國的船舶浮動抵押制度,并在浮動抵押制度的體系下,完善船舶抵押“登記對抗”制度,進一步明確“共有船舶抵押設(shè)定”及“抵押船舶轉(zhuǎn)讓”等兩個問題的爭議,從而使航運法律更好地為航運實踐保駕護航。
[Abstract]:There is a very special mortgage system in the guarantee law system of our country, that is, the ship mortgage system, it is a kind of guarantee system which takes the ship as the collateral, therefore, The system can be applied to the provisions of the Maritime Law of the people's Republic of China and the guarantee Law of the people's Republic of China, but, unfortunately, although they have been adjusted by both laws at the same time, However, there are still many problems and disputes in the judicial practice of ship mortgage. The reason for these problems is that the two laws have relatively few provisions on ship mortgage, and there are some flaws and ambiguities in the provisions themselves. Even in some places, the provisions of these two laws are contradictory, and the theoretical viewpoint of making the law is different from that of today. With the rapid development of shipping industry, if these problems can not be coordinated or solved in time, the further development of China's shipping industry will be hindered directly or indirectly by these problems. The Real right Law of the people's Republic of China, which was formally implemented on October 1, 2007, has patched and perfected the guarantee legal system of our country. Under such a background, how to adapt to the situation, It is necessary to perfect the ship mortgage system of our country-which has become the main purpose of this paper. This paper is divided into three parts, starting from the basic theory of jurisprudence and the spirit of new legislation, putting forward facts, reasoning and giving examples, not only discusses the impact of property law on the establishment of floating mortgage system and ship mortgage registration system in China. It also discusses the influence of real right law on some other problems in ship mortgage, such as "how to set mortgage for common ship" and so on. Through the above research, this paper draws the following conclusions: our country can set up the floating charge system of ships in our country from the subject, object and realization way of mortgage, and under the system of floating charge system, It is necessary to perfect the system of "register confrontation" of ship mortgage, further clarify the dispute of "common ship mortgage setting" and "mortgage ship transfer", so that shipping law can better protect shipping practice.
