【摘要】：本文從海商法、保險法、合同法等的角度,在現(xiàn)行法律體系下分析了溫州人保船舶保險合同糾紛一案中船舶保險訴訟主體資格的確定、船舶保險中被保險人的如實告知義務(wù)的是否履行；闡述了溫州人保船舶保險合同糾紛一案中涉及的訴訟時效中斷、不真正連帶責(zé)任的適用問題。本文第三部分,著重就我國海商法對訴訟時效的規(guī)定加以闡述并提出予以完善的必要性。對在擬修訂的海商法中是否引入英美法系下的最大誠信原則提出自己的建議。本文運用實證、比較的方法,對溫州人保船舶保險合同糾紛一案中的船舶保險訴訟主體、訴訟時效、不真正連帶責(zé)任及被保險人告知義務(wù)等加以分析,從而有針對性的提出相應(yīng)的適用策略。
[Abstract]:From the angles of maritime law, insurance law, contract law and so on, this paper analyzes the qualification of the main body of ship insurance litigation in Wenzhou PICC contract dispute case under the current legal system. Whether to fulfill the truthful obligation of informing the insured in the marine insurance, and to expound the application of the limitation limit in the case of Wenzhou PICC contract dispute, which is not really joint and several liability. In the third part of this paper, the necessity of perfecting the statute of limitations in China's maritime law is put forward. This paper puts forward some suggestions on whether to introduce the principle of maximum good faith under the common law system in the maritime law to be revised. This paper, by using empirical and comparative methods, analyzes the subject, limitation, untrue joint and several liability and the obligation to inform the insured in the case of Wenzhou PICC contract dispute. Therefore, the corresponding applicable strategies are put forward.
