【摘要】： 近年來,隨著索馬里附近愈演愈烈的海盜問題,世界航運面臨著越來越嚴重的海盜劫持和支付贖金的壓力。航運實務(wù)界和理論界也不得不重新審視索馬里武裝分子劫持船舶索要贖金所帶來的各種法律問題。本文即通過系統(tǒng)的理論分析,從海商法和海上保險法律相關(guān)制度的歷史和基礎(chǔ)理論入手,結(jié)合近年來各國對有關(guān)海盜贖金法律保險賠付法律問題的探討和實踐,并以我國的相關(guān)法律規(guī)定和實踐為基礎(chǔ),綜合分析了與海盜的界定、海盜贖金的性質(zhì)和海盜贖金保險賠付有關(guān)的諸多理論和實踐問題,以期能夠?qū)ξ覈南嚓P(guān)理論研究和實踐提供參考。 除引言和摘要外,本文共分三章。第一章主要介紹索馬里海盜問題的現(xiàn)狀和索馬里海盜的特點,指出索馬里海盜在獲利方式、導(dǎo)致的損失的形式和給被保險人造成的風(fēng)險等方面與傳統(tǒng)的海盜存在較大不同,而船東在面對索馬里海盜的劫持時幾乎也只能以支付贖金的方式來解決危機。第二章主要探討支付給索馬里海盜的贖金在性質(zhì)上屬于海上保險法下的何種損失,在充分借鑒國外已有經(jīng)驗的基礎(chǔ)上,本文綜合分析了海上保險法下的各類損失的歷史、要件和特點,并結(jié)合我國相關(guān)的法律規(guī)定和理論研究成果,提出索馬里海盜贖金在海上保險下可以以共同海損或施救費用的方式獲得賠償。本文第三章主要通過介紹相關(guān)保險條款的規(guī)定,討論船東如何依據(jù)兩種被我國廣泛使用的保險條款獲得對海盜贖金損失的賠償,同時也討論了船舶保賠保險、綁架和贖金保險在相關(guān)問題上的地位,以期對相關(guān)實踐有所幫助。
[Abstract]:In recent years, with the growing problem of piracy near Somalia, world shipping is facing more and more serious pressure of piracy hijacking and ransom payment. Shipping practitioners and theorists also have to re-examine the legal problems caused by Somali militants hijacking ships for ransom. This paper begins with the history and basic theory of maritime law and marine insurance law, and combines the discussion and practice of various countries in recent years on the legal problems of pirate ransom law insurance payment, through the systematic theoretical analysis, and starting with the history and basic theory of maritime law and marine insurance law. On the basis of the relevant laws and regulations and practice of our country, this paper comprehensively analyzes many theoretical and practical problems related to the definition of piracy, the nature of ransom for pirates and the payment of ransom insurance for pirates. In order to provide a reference for the relevant theoretical research and practice in China. In addition to the introduction and summary, this paper is divided into three chapters. The first chapter mainly introduces the current situation of Somali piracy and the characteristics of Somali pirates, and points out that Somali pirates are quite different from traditional pirates in the way of profit, the form of loss and the risk to the insured. And shipowners almost have to pay ransoms to solve the crisis in the face of Somali pirates hijacking. The second chapter mainly discusses what kind of loss is paid to Somali pirates under the maritime insurance law in nature. On the basis of fully drawing on the experience of foreign countries, this paper comprehensively analyzes the history of various kinds of losses under the maritime insurance law. In combination with the relevant legal provisions and theoretical research results of our country, it is proposed that Somali pirate ransom can be compensated in the form of general average or rescue expenses under marine insurance. The third chapter mainly discusses how shipowners get compensation for pirate ransom loss according to two kinds of insurance clauses widely used in our country by introducing the provisions of relevant insurance clauses. At the same time, it also discusses ship insurance. Kidnapping and ransom insurance in the status of related issues, in order to help the relevant practice.
