【摘要】：我國(guó)有關(guān)留置權(quán)的規(guī)定主要見(jiàn)于《民法通則》、《合同法》、《擔(dān)保法》及司法解釋中,而對(duì)于特別留置權(quán)的海上貨物留置權(quán)來(lái)說(shuō)只在我國(guó)《海商法》第87,88條中出現(xiàn),由于海上貨物運(yùn)輸中法律關(guān)系較為復(fù)雜,我國(guó)海商法中關(guān)于貨物留置權(quán)的相關(guān)法律規(guī)定不夠完善,隨著我國(guó)航運(yùn)事業(yè)的蓬勃發(fā)展,在海上貨物運(yùn)輸中,承運(yùn)人的留置權(quán)仍然是發(fā)生糾紛較多的問(wèn)題,因此如何保證海上貨物留置權(quán)的正確行使對(duì)于承運(yùn)人切身利益的保障是極為重要的。本文主要對(duì)海上貨物留置權(quán)的性質(zhì)、成立、行使、留置權(quán)所有權(quán)歸屬等問(wèn)題進(jìn)行了較為全面的探討。除了引言之外,全文共分為四章。 第一章對(duì)一般留置權(quán)及海上貨物留置權(quán)的基本理論進(jìn)行了介紹。此外對(duì)不同國(guó)家和地區(qū)關(guān)于留置權(quán)的立法以及我國(guó)海上貨物運(yùn)輸中留置權(quán)的相關(guān)規(guī)定進(jìn)行了論述。 第二章主要論述了海上貨物留置權(quán)的成立要件、行使及消滅的情況。 第三章分析了海上貨物留置權(quán)對(duì)留置權(quán)人和貨物所有人的法律效力以及海上貨物留置權(quán)所擔(dān)保的債權(quán)項(xiàng)目。 第四章主要對(duì)海上留置物所有權(quán)歸屬問(wèn)題進(jìn)行論述,并對(duì)海上貨物留置權(quán)法律制度的完善提出建議。 通過(guò)本文,希望盡可能的使承運(yùn)人的合法權(quán)益得到保障,平衡船貨雙方的利益,從而更好的促進(jìn)航運(yùn)事業(yè)的健康穩(wěn)定發(fā)展,為完善海上貨物留置權(quán)法律制度盡一份微薄之力。
[Abstract]:The provisions on lien in China are mainly found in the General principles of Civil Law, contract Law, Guaranty Law and judicial interpretation, but for the special lien, the lien on goods on the sea only appears in Article 87 / 88 of the Maritime Law of China. Due to the complexity of the legal relationship in the maritime cargo transportation, the relevant legal provisions on the lien of goods in the maritime law of our country are not perfect enough. With the vigorous development of the shipping industry in our country, in the maritime cargo transportation, The carrier's lien is still a more controversial issue, so how to ensure the correct exercise of the right of lien of goods at sea is very important to the protection of the carrier's vital interests. This paper mainly discusses the nature, establishment, exercise and ownership of the lien of marine cargo. In addition to the introduction, the full text is divided into four chapters. The first chapter introduces the basic theory of general lien and marine cargo lien. In addition, the legislation of the lien in different countries and regions and the relevant provisions of the lien in the carriage of goods by sea in China are discussed. The second chapter mainly discusses the establishment of the maritime cargo lien, the exercise and elimination of the situation. The third chapter analyzes the legal effect of the lien on the lien and the owner of the goods, as well as the claims secured by the lien of the goods. The fourth chapter mainly discusses the ownership of maritime lien, and puts forward some suggestions on how to perfect the legal system of maritime lien. Through this article, I hope that the carrier's legitimate rights and interests can be protected as far as possible, balance the interests of both the ship and cargo, thus better promote the healthy and stable development of the shipping industry, and make a modest contribution to the improvement of the legal system of the lien of marine cargo.
