【摘要】：外國投資非商業(yè)風(fēng)險(xiǎn) (有時(shí)亦稱“政治風(fēng)險(xiǎn)”)保險(xiǎn)是一種兼有私法與公法性質(zhì)的綜合法律關(guān)系。其保險(xiǎn)人包括 :作為私法組織的國內(nèi)保險(xiǎn)公司、國家保險(xiǎn)代理人和國際代理人。前者與后兩者最明顯的區(qū)別在于解決代位求償問題。非商業(yè)風(fēng)險(xiǎn)多與接受投資國直接或間接的行為有關(guān) ,有些戰(zhàn)爭與內(nèi)亂風(fēng)險(xiǎn)除外。非商業(yè)風(fēng)險(xiǎn)保險(xiǎn)的保險(xiǎn)利益 ,即該保險(xiǎn)法律關(guān)系客體 (標(biāo)的 )是保全外國投資的利益。存在保險(xiǎn)利益的投資范圍是受有關(guān)保險(xiǎn)代理人的實(shí)際做法和規(guī)章限制的 ,如對投資種類的限制、保賠數(shù)額的限制。雖然如此 ,非商業(yè)風(fēng)險(xiǎn)保險(xiǎn)依然是一項(xiàng)基本的民商法制度 ,它可以有效地為海外投資提供法律保護(hù)
