【摘要】：為了研究中世紀(jì)商人法的真正形貌,文章主要采用歷史研究方法和比較研究方法等,對商人法各種史料進(jìn)行了考察,認(rèn)為在中世紀(jì)時期,商人社會無法發(fā)展出一套具有普遍性、系統(tǒng)性的和完全自治的法律體系;國內(nèi)外國際商法學(xué)者對中世紀(jì)商人法的認(rèn)知存在著證據(jù)支持不足問題;構(gòu)建新世紀(jì)的跨國商人法規(guī)則,并不需要借助并不存在的中世紀(jì)商人法烏托邦來證明其具有"歷史正當(dāng)性"。中世紀(jì)的商人法不可能成為現(xiàn)代國際商法的模范和依托;構(gòu)建新的統(tǒng)一商法體系應(yīng)該考量現(xiàn)今的國際貿(mào)易形式和國家法律制度現(xiàn)狀,將工作的著眼點(diǎn)放置在對各國國家法的比較和協(xié)調(diào)上,商人社會所謂的自治性民間規(guī)則只能起到有限的輔助作用。
[Abstract]:In order to study the morphology of the medieval law merchant, this article mainly uses the method of historical research and comparative research methods, the merchant law of various materials were investigated, that in the middle ages, the merchant society cannot develop a universal, systematic and complete legal system of self governance; the domestic and foreign scholars on the cognition of international commercial law the medieval law merchant there is evidence to support the problem; constructing transnational merchant law rules of the new century, does not need the help of merchant law Utopia does not exist to prove its historical legitimacy. "Merchant law could not become a model and relying on modern international law; to build a unified system of commercial law should be considered in the new international the form of trade and current situation of the legal system of the state, will work with emphasis placed on the comparison and coordination of the national law in many countries, the so-called social businessmen The autonomy of the folk rules can only play a limited auxiliary role.
