【摘要】： 海上保險法中的保證制度起源于英國海上保險，在英國保險實踐中占有重要的地位。在我國，保證則是海上保險合同法中特有的一項法律制度。然而遺憾的是，無論在我國的《保險法》還是在《海商法》中，均沒有對保證這一重要概念作出定義。我國法律中僅有的關(guān)于保證的內(nèi)容就是《海商法》第235條關(guān)于違反保證的后果的規(guī)定。我國這種立法上的疏漏與保證在保險中，特別是海上保險法中的重要地位是不相稱的，也由此導(dǎo)致了我國海上保險實務(wù)與司法實踐中的一些問題。 由于我國立法對海上保險中保證制度規(guī)定的不完善，國內(nèi)海商法學(xué)界對保證的相關(guān)法律問題展開了熱烈的討論。爭論的焦點集中在保證的定義、保證的法律性質(zhì)、違反保證的法律后果等問題上。為了解決上述問題，本文從英國法出發(fā)，對英國海上保險法中保證制度的法律特征作一全面的考察。然后，，在全面理解英國海上保險法中保證制度的基礎(chǔ)上，提出對我國海上保險法中保證制度的理解和完善。最后，結(jié)合海上保險中保證制度的未來發(fā)展趨勢，對我國立法提出相應(yīng)的修改意見。
[Abstract]:The warranty system in marine insurance law originates from British marine insurance and plays an important role in British insurance practice. In our country, warranty is a special legal system in marine insurance contract law. Whether in China's Insurance Law or in the Maritime Law, There is no definition of the important concept of warranty. The only content of our law concerning warranty is the provisions of article 235 of the Maritime Code on the consequences of breach of warranty. Especially the important position in the marine insurance law is not proportionate, which also leads to some problems in the practice and judicial practice of marine insurance in China. Due to the imperfection of the guarantee system in the marine insurance in our country's legislation, the domestic maritime law circles have carried out a heated discussion on the relevant legal issues of the guaranty. The focus of the debate is on the definition of the guarantee and the legal nature of the guarantee. In order to solve the above problems, this paper, proceeding from the English law, makes a comprehensive investigation on the legal characteristics of the warranty system in the English Maritime Insurance Law, and then, in order to solve the above problems, the author makes a comprehensive investigation on the legal characteristics of the warranty system in the English Maritime Insurance Law. On the basis of a comprehensive understanding of the warranty system in the British Marine Insurance Law, this paper puts forward the understanding and perfection of the guarantee system in the Marine Insurance Law of our country. Finally, combined with the future development trend of the warranty system in the marine insurance law, To our country legislation puts forward the corresponding amendment opinion.
