【摘要】：隨著航運物流業(yè)的發(fā)展,航運物流經(jīng)營人的服務(wù)范圍逐漸擴(kuò)大,同時,航運物流經(jīng)營人承擔(dān)的風(fēng)險也越來越大。因此,航運物流經(jīng)營人急需配套的物流保險來轉(zhuǎn)移自己在運營活動中面臨的風(fēng)險。然而,傳統(tǒng)的物流保險難以滿足物流發(fā)展的需要,現(xiàn)有的物流責(zé)任保險條款與物流經(jīng)營人的需求之間還存在很大差距。為航運物流經(jīng)營人提供適合的保險,并解決一系列的法律問題,才能進(jìn)一步促進(jìn)航運物流業(yè)的發(fā)展。本文將就航運物流責(zé)任綜合保險的一些法律問題展開討論。本文主要分為四個部分： 第一章寫了航運物流責(zé)任綜合保險的概述。首先從責(zé)任保險、物流保險的含義去探討航運物流責(zé)任綜合保險的含義;然后分析了航運物流責(zé)任綜合保險與其他類似保險的區(qū)別；最后介紹了航運物流責(zé)任綜合保險在國內(nèi)外的發(fā)展現(xiàn)狀； 第二章主要研究了航運物流責(zé)任綜合保險合同的主體及主要內(nèi)容。首先介紹了航運物流責(zé)任綜合保險合同的保險人和被保險人；然后對航運物流責(zé)任綜合保險的承保范圍及責(zé)任限額與免賠額進(jìn)行了介紹 第三章分析了航運物流責(zé)任綜合保險的性質(zhì)和法律適用。首先分析了我國現(xiàn)有的調(diào)整航運物流責(zé)任綜合保險的法律法規(guī),找出其存在的問題；然后主要探討了《海商法》與《保險法》的適用范圍；最后研究了聯(lián)運保賠協(xié)會的會員先付條款與第三人直接訴權(quán)的沖突問題。 最后一章提出了完善我國航運物流責(zé)任綜合保險的建議。分別從我國航運物流責(zé)任綜合保險的立法體系,保險合同的承保范圍,第三人直接訴權(quán),互保性質(zhì)航運物流責(zé)任綜合保險方面來分析。
[Abstract]:With the development of shipping logistics industry, the scope of service of shipping logistics operators is gradually expanding, and the risks borne by shipping logistics operators are also increasing. Shipping logistics operators are in urgent need of supporting logistics insurance to transfer the risks they face in their operations. However, traditional logistics insurance is difficult to meet the needs of logistics development. There is still a big gap between the existing provisions of logistics liability insurance and the needs of logistics operators. It provides suitable insurance for shipping logistics operators and solves a series of legal problems. In order to further promote the development of shipping logistics industry. This paper will discuss some legal issues of comprehensive liability insurance for shipping logistics. This paper is divided into four parts:. The first chapter has written the shipping logistics liability synthesis insurance outline. First from the responsibility insurance, the logistics insurance meaning to discuss the shipping logistics responsibility synthesis insurance meaning; Then it analyzes the differences between shipping logistics liability comprehensive insurance and other similar insurance, and finally introduces the development status of shipping logistics liability comprehensive insurance at home and abroad. The second chapter mainly studies the main body and the main content of the comprehensive insurance contract of shipping logistics liability. Firstly, it introduces the insurer and the insured of the comprehensive insurance contract of shipping logistics liability. Then it introduces the insurance coverage, liability limit and deductible amount of shipping logistics liability comprehensive insurance. The third chapter analyzes the nature and legal application of the comprehensive insurance of shipping logistics liability. Firstly, it analyzes the existing laws and regulations to adjust the comprehensive insurance of shipping logistics liability, and finds out the existing problems. Then it mainly discusses the scope of application of Maritime Law and Insurance Law, and finally studies the conflict between the member's advance payment clause and the third party's right of direct action. In the last chapter, some suggestions are put forward to perfect the comprehensive insurance of shipping logistics liability in our country. From the legislative system of comprehensive insurance of shipping logistics liability in China, the scope of insurance contract, the right of direct action of the third party, Mutual insurance nature of shipping logistics liability comprehensive insurance to analyze.
