【摘要】：正 在法國商務(wù)活動中,常常出現(xiàn)法無明文規(guī)定或適用法律困難的特殊商事合同問題。當(dāng)出現(xiàn)這些特殊合同問題時,合同當(dāng)事人會盡力尋找解決問題的相關(guān)法律依據(jù);訴至法院時,法官也會對判決加以解釋;這些問題也是法國法學(xué)家研究和爭鳴的熱點問題。筆者有幸在法國研修法國商法,對法國當(dāng)前商務(wù)活動中出現(xiàn)的這些特殊合同問題頗感興趣,在法學(xué)雜志《商法判例》中讀到了大量這方面的案例,現(xiàn)選擇點滴以饗讀者。
[Abstract]:In French commercial activities, there are often special commercial contract problems which are not stipulated in law or difficult to apply the law. When these special contract problems arise, the parties to the contract will try their best to find the relevant legal basis to solve the problem. When brought to the court, the judge also interprets the judgment; these questions are also hot issues in the study and contending of French jurists. I have the honour to study French commercial law in France. Interested in these special contract problems arising from the current business activities in France, a large number of such cases have been read in the Journal of Law on Commercial Law.
