【摘要】： 權(quán)利外觀理論是商法的基本理論之一,它是德國私法學(xué)者在二十世紀初創(chuàng)立的,雖然我國學(xué)者對權(quán)利外觀理論的研究較晚,但是這并不影響其在票據(jù)法領(lǐng)域的重要性,因為權(quán)利外觀理論的宗旨在于維護交易安全,這無疑與票據(jù)法的立法理念相統(tǒng)一。本論文從票據(jù)抗辯分類體系的缺陷入手,以權(quán)利外觀理論重新對票據(jù)抗辯的分類體系進行構(gòu)建,即將票據(jù)抗辯分為：對物的抗辯、對人的抗辯和有效性抗辯,擬用權(quán)利外觀理論對票據(jù)抗辯重新進行解釋,以達到完善票據(jù)抗辯制度的目的。
[Abstract]:The right appearance theory is one of the basic theory of commercial law, it is the creation of German private law scholars at the beginning of twentieth Century, although the appearance of Chinese scholars on the rights theory of late, but this does not affect its importance in the field of law of negotiable instruments, because the right appearance theory aims to maintain the security of transactions, it is with the legislation of bills the idea of unity. This paper from the paper defect classification system defenses start to look right again the theory of bill plea classification system for construction, the defense is divided into: the matter of defense, the defense and effectiveness of defense, intends to use the right appearance theory of negotiable re interpretation, in order to achieve improve the system of negotiable instruments.
