海上保險代位權(quán)相對性地突破了合同相對性原則,是民法債權(quán)制度功能的進一步發(fā)展。海上保險代位權(quán)的法律屬性為債權(quán)的法定轉(zhuǎn)移。海上保險代位權(quán)兼具了實體法和程序法的雙重性質(zhì)。海上保險代位權(quán)制度應(yīng)予以修訂和完善。
