【摘要】：正順應農(nóng)民意愿,實現(xiàn)承包權和經(jīng)營權分置并行,是我國農(nóng)地制度的又一大創(chuàng)新。目前,在大多數(shù)地區(qū),承包權與經(jīng)營權分置的條件已基本成熟,土地所有權、承包權、經(jīng)營權"三權分置"將是今后農(nóng)地制度的一條主線。2015年中央一號文件提出要界定農(nóng)村土地集體所有權、農(nóng)戶承包權、土地經(jīng)營權之間的權利關系,這就需要首先界定三權各自權利性質及權能,而土地經(jīng)營權作為新創(chuàng)立的一種獨立權利形態(tài),更需要及時界定。土地經(jīng)營權是流轉情況下才獨立于承包權
