孝治的終結(jié)與法治的興起——從《老年人權(quán)益保障法》第17條切入

【摘要】:孝治是傳統(tǒng)中國(guó)家國(guó)同構(gòu)和圣賢政治的產(chǎn)物。隨著中國(guó)社會(huì)從圣賢政治到民主政治、從家國(guó)同構(gòu)到家國(guó)兩分、從"家庭人"到"社會(huì)人"的轉(zhuǎn)變,傳統(tǒng)的孝治也逐漸被法治所取代。修訂后的《老年人權(quán)益保障法》第17條既體現(xiàn)了法治的精義,又標(biāo)志著法治在當(dāng)代中國(guó)的興起。這是因?yàn)?法治是一個(gè)漸進(jìn)的過(guò)程,最容易接受法律治理的領(lǐng)域是一些與個(gè)人身份無(wú)關(guān)的領(lǐng)域,家庭關(guān)系是法治最難攻克的堡壘。修訂后的《老年人權(quán)益保障法》第17條并非"孝道入法",它把傳統(tǒng)的父母與子女之間的血緣性的倫理關(guān)系變成了平等主體之間的法律關(guān)系。在這個(gè)條款中,傳統(tǒng)的需要盡孝的"父母"已經(jīng)不復(fù)存在,已經(jīng)被替換成為沒(méi)有任何倫理指向的"老年人"。傳統(tǒng)的子女則被替換成"家庭成員"或"贍養(yǎng)人"。這樣的替換從制度上抹去了傳統(tǒng)的孝道,同時(shí)也在法律上終結(jié)了傳統(tǒng)的孝治。與此同時(shí),隨著家庭內(nèi)部關(guān)系完全納入到法律調(diào)整的領(lǐng)域,表明家庭這個(gè)最難被法治攻克的領(lǐng)域,已經(jīng)成為法治的轄區(qū)。因此,《老年人權(quán)益保障法》第17條具有標(biāo)本意義:它既是孝治終結(jié)的標(biāo)本,亦是法治興起的標(biāo)本。
[Abstract]:Filial piety is the product of traditional national isomorphism and sage politics. With the transformation of Chinese society from saints politics to democracy, from homogeneity of family to family and from "family" to "social person", the traditional filial piety is gradually replaced by the rule of law. Article 17 of the revised Law on the Protection of the Rights and interests of the elderly not only embodies the essence of the rule of law, but also marks the rise of the rule of law in contemporary China. This is because the rule of law is a gradual process, the most easily accepted areas of legal governance are some areas independent of personal identity, family relations are the most difficult fortress of the rule of law. Article 17 of the revised Law on the Protection of the Rights and interests of the elderly is not "filial piety into law", it turns the traditional ethical relationship between parents and children into the legal relationship between equal subjects. In this provision, traditional "parents" who need filial piety no longer exist and have been replaced by "old people" without any ethical point. Traditional children are replaced by "family members" or "dependants". This replacement erased the traditional filial piety from the system, but also ended the traditional filial piety in the law. At the same time, with the family relations fully incorporated into the field of legal adjustment, it shows that the family, which is the most difficult area to be conquered by the rule of law, has become the jurisdiction of the rule of law. Therefore, Article 17 of the Law on the Protection of the Rights and interests of the elderly has the significance of specimen: it is not only the specimen of the end of filial piety, but also the specimen of the rise of rule of law.
