【摘要】："一帶一路"貿(mào)易便利化與海關(guān)知識(shí)產(chǎn)權(quán)保護(hù)在本質(zhì)上并非對峙關(guān)系,而是互相兼容的。一方面,"一帶一路"戰(zhàn)略豐富了傳統(tǒng)的貿(mào)易便利化理論的內(nèi)涵與外延,是海關(guān)知識(shí)產(chǎn)權(quán)保護(hù)恪守的指南;另一方面,海關(guān)知識(shí)產(chǎn)權(quán)保護(hù)輔助并加速"一帶一路"的貿(mào)易便利化進(jìn)程。為了保持兩者高度契合的關(guān)系,需要克服貶抑貿(mào)易便利化的國內(nèi)立法和區(qū)域性國際法的諸多問題,包括海關(guān)知識(shí)產(chǎn)權(quán)保護(hù)備案的國內(nèi)立法和國際合作機(jī)制的弊端,國際聯(lián)合擔(dān)保尚未被推而廣之,反擔(dān)保在國內(nèi)立法中的適用過于狹窄,以及貫通歐亞大陸、過境歐盟時(shí)遭遇的不公正執(zhí)法問題等。為了彌補(bǔ)上述偏弊,一方面建議簽署更多具有實(shí)質(zhì)內(nèi)容的海關(guān)知識(shí)產(chǎn)權(quán)合作協(xié)議,推動(dòng)TIR單證式的聯(lián)合擔(dān)保;另一方面,建議修訂《知識(shí)產(chǎn)權(quán)海關(guān)保護(hù)條例》,擴(kuò)充反擔(dān)保所適用的外延,細(xì)化申請書需要登記的有關(guān)事項(xiàng),增加因疏于信息更新義務(wù)所必須給予的懲戒。
[Abstract]:Belt and Road's trade facilitation and the protection of customs intellectual property rights are not antagonistic in nature, but compatible with each other. On the one hand, the "Belt and Road" strategy enriches the connotation and extension of the traditional trade facilitation theory and is a guide to the protection of customs intellectual property rights; on the other hand, Customs intellectual property protection assists and speeds up the trade facilitation process of Belt and Road. In order to maintain a highly compatible relationship, there is a need to overcome the many problems of domestic legislation derogating from trade facilitation and regional international law, including the shortcomings of domestic legislation and international cooperation mechanisms for the protection of customs intellectual property rights, International joint guarantee has not been extended, the application of anti-guarantee in domestic legislation is too narrow, and the unfair law enforcement problems encountered in the transit of EU through Eurasia, etc. In order to remedy the above shortcomings, on the one hand, it is proposed to sign more substantive customs intellectual property cooperation agreements to promote TIR documentary joint guarantees; on the other hand, It is suggested that the regulations on Customs Protection of intellectual property Rights should be amended to expand the extension of the anti-guarantee, to refine the relevant items that need to be registered in the application form, and to increase the punishment that must be given because of the omission of the obligation to update information.
