【摘要】：大學(xué)生村官計劃從20世紀(jì)末推廣至今已有二十個年頭。隨著“大學(xué)生村官計劃”推廣的深入,越來越多的大學(xué)生加入新農(nóng)村建設(shè)主力軍行列,因此大學(xué)生村官隊(duì)伍受到外界社會的廣泛關(guān)注。然而政策是適應(yīng)當(dāng)時社會所制定,隨著這個群體的壯大,因?yàn)闆]有應(yīng)時的政策,所以難以滿足現(xiàn)時的大學(xué)生村官發(fā)展的需要。在現(xiàn)行大學(xué)生村官制度中,大學(xué)生村官的諸多權(quán)益得不到與之相適應(yīng)的法律保障,尤其是部分政策和規(guī)章制度關(guān)于大學(xué)生村官身份和管理的規(guī)定直接導(dǎo)致大學(xué)生村官基本權(quán)益難以實(shí)現(xiàn)�，F(xiàn)行大學(xué)生村官制度存在的問題,主要表現(xiàn)為大學(xué)生村官法律身份的困境以及在此基礎(chǔ)上所產(chǎn)生的相關(guān)法律關(guān)系不明、政策與法律適用上的沖突、權(quán)利救濟(jì)困難。本文力圖通過對上述關(guān)鍵性的四個問題的法律思考,剖析大學(xué)生村官基本權(quán)益難以實(shí)現(xiàn)的深層次原因,包括從政策定位不清、管理較亂、相關(guān)配套措施缺失、立法滯后等方面進(jìn)行分析,最后為大學(xué)生村官制度建設(shè)提供法律建議,即從制度上明確身份性質(zhì)、確定統(tǒng)一管理的法律依據(jù)、完善相關(guān)配套措施及權(quán)利救濟(jì)程序方面構(gòu)建方案,使大學(xué)生村官的權(quán)益得到全面的法律保障,進(jìn)而推動大學(xué)生村官事業(yè)獲得法律的維護(hù)和保障,為大學(xué)生村官長期扎根基層服務(wù)農(nóng)村而奠定堅(jiān)實(shí)的制度基礎(chǔ)。
[Abstract]:It has been twenty years since the end of the 20 th century.With the popularization of the "College Student Village official Plan", more and more college students join the main force of the new rural construction, so the college student village official team is widely concerned by the outside society.However, the policy is to adapt to the society at that time, with the expansion of this group, because there is no timely policy, so it is difficult to meet the needs of the development of college students village officials.In the current university student village official system, many rights and interests of university student village officials can not be matched with the legal protection.Especially some policies and regulations on the status and management of college students' village officials directly lead to the realization of the basic rights and interests of university students' village officials.The problems existing in the current university student village official system are mainly manifested in the dilemma of the legal status of the university student village official and the related legal relations arising on this basis, the conflict between the policy and the law application, and the difficulty of right relief.This paper tries to analyze the deep-seated reasons why the basic rights and interests of college students' village officials are difficult to realize through the legal thinking on the four key issues mentioned above, including the unclear policy orientation, chaotic management and lack of relevant supporting measures.Finally, it provides legal advice for the construction of university student village official system, that is, defining the nature of identity from the system, determining the legal basis of unified management, perfecting the relevant supporting measures and the right relief program.So that the rights and interests of college students' village officials can be fully protected, and then the cause of university students' village officials can be safeguarded and guaranteed by law, thus laying a solid institutional foundation for the university students' village officials to take root in serving the countryside at the grass-roots level for a long time.
