【摘要】：隨著世界人口老齡化趨勢(shì)不斷加深,國(guó)際人權(quán)保障理念日益更新,世界各國(guó)相繼進(jìn)行了成年監(jiān)護(hù)制度的改革,成年意定監(jiān)護(hù)制度應(yīng)運(yùn)而生。我國(guó)人口老齡化問(wèn)題更加嚴(yán)峻,加之現(xiàn)有保護(hù)成年人的監(jiān)護(hù)立法理念落后,尤其是缺乏對(duì)個(gè)人自主決定權(quán)的尊重和殘余能力的重視,現(xiàn)有的成年監(jiān)護(hù)制度對(duì)于身心障礙者面臨的人身照顧、財(cái)產(chǎn)管理等問(wèn)題缺乏解決的措施�！独夏耆藱�(quán)益保障法》雖已對(duì)老年意定監(jiān)護(hù)進(jìn)行了規(guī)定,但其內(nèi)容過(guò)于原則性,且存在制度體系混亂、監(jiān)護(hù)主體范圍狹窄、意定監(jiān)護(hù)具體的內(nèi)容缺失、缺少意定監(jiān)護(hù)監(jiān)督制度等問(wèn)題。因此,借我國(guó)民法典編纂的契機(jī),構(gòu)建我國(guó)的成年意定監(jiān)護(hù)制度刻不容緩�；谖覈�(guó)目前的社會(huì)現(xiàn)狀、立法情況及學(xué)界觀點(diǎn),通過(guò)對(duì)比《民法總則》和民法典各建議稿中關(guān)于成年意定監(jiān)護(hù)制度的規(guī)定,區(qū)分其適用的不同立法模式,就此為民法典立法體例的選擇,應(yīng)將成年意定監(jiān)護(hù)制度先在民法典總則中作出原則性的規(guī)定,其他具體的內(nèi)容以單行法的方式進(jìn)行規(guī)定;并結(jié)合其他國(guó)家的立法經(jīng)驗(yàn)對(duì)成年意定監(jiān)護(hù)制度作出具體化、系統(tǒng)性的規(guī)定,對(duì)成年意定監(jiān)護(hù)合同的主體、訂立、生效、終止等進(jìn)行具體規(guī)定,以及對(duì)成年意定監(jiān)護(hù)登記制度、意定監(jiān)護(hù)監(jiān)督制度進(jìn)行具體構(gòu)建,以實(shí)現(xiàn)對(duì)老年人、身體或精神障礙者等弱勢(shì)群體基本人權(quán)的保障。
[Abstract]:With the aging trend of the world population deepening and the concept of international human rights protection being updated day by day, various countries in the world have carried out the reform of the adult guardianship system one after another, and the adult determined guardianship system has emerged as the times require.The problem of aging population in our country is more serious, coupled with the backward concept of guardianship legislation for the protection of adults, especially the lack of respect for individual autonomy and the importance of residual ability.The existing adult guardianship system lacks measures to solve the problems of personal care and property management faced by the disabled. Although the Law on the Protection of the Rights and interests of the elderly has provided for voluntary guardianship for the elderly, its contents are too principled.And there are some problems, such as confusion of system, narrow scope of guardianship subject, lack of specific content and lack of supervision system.Therefore, it is urgent to construct the adult guardianship system by taking the opportunity of compiling the civil code of our country.Based on the current social situation, legislative situation and academic viewpoint of our country, by comparing the provisions of the General principles of Civil Law and the various proposals of the Civil Code on the system of adult voluntary guardianship, the author distinguishes the different legislative models of its application.This is the choice of the legislative system of the Civil Code. The system of adult compulsory guardianship should be stipulated in principle in the general rules of the Civil Code first, and the other specific contents should be stipulated in the form of a single law.Combined with the legislative experience of other countries, the system of adult compulsory guardianship is specified and systematized, the main body of adult voluntary guardianship contract, the conclusion, entry into force, termination and so on, as well as the registration system of adult voluntary guardianship, are specified.In order to realize the protection of basic human rights of the elderly, the physically or mentally handicapped and other vulnerable groups, the system of supervision and supervision of voluntary guardianship is constructed concretely.
