法律翻譯是兩種不同語(yǔ)言之間的轉(zhuǎn)換，因此了解法律語(yǔ)言的特點(diǎn)對(duì)法律翻譯工作十分重要。就法律英語(yǔ)而言，國(guó)內(nèi)外無(wú)論是法律界還是語(yǔ)言學(xué)界的學(xué)者均對(duì)其進(jìn)行了卓有成效的研究和探索，如陳忠誠(chéng)，Henry Weihofen，Anna Trosborg等。法律翻譯可在不同法系間、不同文化和語(yǔ)言間轉(zhuǎn)化，涉及范圍廣、類型多樣。本文擬從法律英語(yǔ)的語(yǔ)言特征出發(fā)，剖析其在詞匯，句法及文體三個(gè)層面上的特點(diǎn)，立足于探討漢語(yǔ)立法文本的英譯，以期以小見(jiàn)大，就法律翻譯問(wèn)題提出一些建議。 論文首先分析了英語(yǔ)立法語(yǔ)言的詞匯、句法和文體特征。在詞匯方面，該語(yǔ)言大量使用古體詞和具有法語(yǔ)和拉丁語(yǔ)淵源的詞，多用術(shù)語(yǔ)而少用代詞，頻繁并列使用雙名詞以及多名詞等表現(xiàn)形式；在句法方面，該語(yǔ)言為了強(qiáng)調(diào)并保證法律的嚴(yán)明以及公正性，立法條文組織都必須遵從一定的邏輯順序，多用長(zhǎng)句、復(fù)雜句、被動(dòng)句和大量的復(fù)雜介詞結(jié)構(gòu)及名詞化形式。在文體方面，法律英語(yǔ)以精確性、正式性、客觀性和一致性為其主要特征。這些語(yǔ)言特征使立法文本具有鮮明的個(gè)性，這些個(gè)性是選擇翻譯方法和評(píng)判譯文標(biāo)準(zhǔn)時(shí)不可忽視的基本要素。 在重視法律翻譯基本原則——準(zhǔn)確、一致和簡(jiǎn)潔——的...
