近年來有關(guān)法律語言的特征分析、法律語言風(fēng)格特征、法律語言與翻譯原則等研究方面出現(xiàn)了一些論文或論著,但關(guān)于英漢法律語言的句法對比研究方面尚有很大研究的空間。為此,本文試圖通過分析英漢立法語言的語體和句法特征,從傳統(tǒng)文化的角度論述了產(chǎn)生這些句法差異的原因,以期對法律語言的深入研究奠定一定基礎(chǔ)。論文除引言和結(jié)語外,共由四章組成。第一章簡要分析了立法語言的主要特征。作者結(jié)合法律的特征,即規(guī)范性、權(quán)威性和抽象性,分析了相應(yīng)的立法語言特征,即精確性、晦澀性和機(jī)械性。第二章主要介紹漢英立法文本的句法特征。文章從句法的定義及其研究對象出發(fā),探討了漢英立法文本在綜合語與分析語、形合與意合、語序、句子信息結(jié)構(gòu)安排、主語突顯與話題突顯及主動(dòng)語態(tài)與被動(dòng)語態(tài)等六個(gè)方面的句法差異。漢語以分析語為主要特征,主要靠意合手段組合句子;它以意念為主軸,話題突顯,多用人稱主語和主動(dòng)語態(tài)。此外,漢語的詞序安排主要以時(shí)、空發(fā)展及心理上的輕重為序,重隱性連貫;句子信息中心一般后置,呈句首開放、句尾封閉型分布。而英語則屬于分析-綜合語,主要靠形合手段組合句子。它以主謂提挈為主軸,主語突顯,常用物稱主語和被動(dòng)語態(tài)。詞序安排上重邏輯推...
