The author in this article holds that the legislative volition hasn't been paid enough attention in this newly-enacted law.On one hand,the utilitarian motives existing in the course of legislation weaken the character of people's volition.On the other hand,a kind of well-operated system of legislative neutrality can hardly be established.What's more,the character of people's volition in legislation is undoubtedly acting as the moral support and provisional origin to all laws.Therefore it will contribute greatly to the ultimate aim and value what the Legislative Law itself pursues and finally attribute to the choice of mandatory legislative system.

立法法 ,因其特定的立法宗旨和目的而成為我國基本法中的基本法。其意義如此重大 ,自然引來人們諸多挑剔的目光 ,即將施行的立法法真的已盡完美了嗎 ?本文認(rèn)為 ,立法法對其立法意志的關(guān)注尚嫌不足 ,一方面 ,功利性的立法動因沖淡了立法的人民意志性 ,另一方面 ,立法中立的良性機(jī)制又難以真正確立。而立法的人民意志性無疑是一切法的精神支柱和生命之源 ,它將成為立法法所追尋的根本價值目標(biāo) ,并最終歸結(jié)于委托立法體制的選擇
