山西省自然保護(hù)區(qū)生態(tài)環(huán)境保護(hù)法律問(wèn)題研究

【摘要】： 自然對(duì)于人類社會(huì)而言,其重要性和戰(zhàn)略意義從來(lái)都是歷久彌新。而建立自然保護(hù)區(qū)則是解決人類自身困境,保護(hù)生態(tài)物種多樣性的重要措施。具體到中國(guó)乃至山西,環(huán)境問(wèn)題的嚴(yán)峻程度其實(shí)已經(jīng)到了無(wú)需贅言的地步,而對(duì)山西省的自然保護(hù)區(qū)管理進(jìn)行法制化思考和設(shè)計(jì)更有其客觀現(xiàn)實(shí)性和必要性。需要反思山西省自然保護(hù)區(qū)法律制度,以科學(xué)發(fā)展觀的理論指導(dǎo)我們的自然保護(hù)區(qū)法治建設(shè)。 自1956年我國(guó)建立第一個(gè)自然保護(hù)區(qū)以來(lái),自然保護(hù)區(qū)的數(shù)量已經(jīng)達(dá)到兩千多個(gè),量不算少,但質(zhì)亟待提高。自然保護(hù)區(qū)建設(shè)和管理過(guò)程中所暴露出的日益嚴(yán)重的問(wèn)題,使我們不得不開(kāi)始思考,我們的自然保護(hù)區(qū)制度究竟怎么了?是什么制約著自然保護(hù)區(qū)的發(fā)展?帶著這些問(wèn)題,筆者按照分析基本情況、發(fā)現(xiàn)問(wèn)題,到尋找原因、解決問(wèn)題的順序,比對(duì)全國(guó)的情況,借鑒國(guó)外發(fā)達(dá)國(guó)家的經(jīng)驗(yàn),對(duì)山西省自然保護(hù)區(qū)的相關(guān)法律問(wèn)題進(jìn)行剖析,最后提出完善的建議。研究自然保護(hù)區(qū)的法律規(guī)制問(wèn)題,對(duì)于自然保護(hù)區(qū)的保護(hù)與充分發(fā)揮其在生態(tài)環(huán)境中的作用意義重大。 本文運(yùn)用了法學(xué)、生態(tài)學(xué)、經(jīng)濟(jì)學(xué)等理論,及引數(shù)據(jù)、列圖表、作比較等方法,對(duì)山西省的自然保護(hù)區(qū)的具體情況做了細(xì)致分析,總結(jié)其特點(diǎn),分析其不足,以此為基礎(chǔ),提出一些完善和解決的意見(jiàn)和建議。 本文共分五個(gè)部分,其構(gòu)思與寫(xiě)作旨在重新梳理人與自然之間的關(guān)系,從自然保護(hù)區(qū)的法治現(xiàn)狀入手,研究和分析山西省自然保護(hù)區(qū)法制建設(shè)中的諸多法律問(wèn)題,同時(shí)對(duì)科學(xué)發(fā)展觀與可持續(xù)發(fā)展理念在環(huán)保立法領(lǐng)域的進(jìn)一步貫徹與落實(shí)提供理論支持。 第一部分是自然保護(hù)區(qū)生態(tài)環(huán)境保護(hù)法律制度的理論基礎(chǔ),從國(guó)際組織、其他國(guó)家和我國(guó)對(duì)自然保護(hù)區(qū)的不同定義等基本問(wèn)題入手進(jìn)行橫向比較,從生態(tài)人類中心主義、可持續(xù)發(fā)展、以及人與自然和諧相處等三個(gè)角度對(duì)“環(huán)境與生態(tài)保護(hù)的理論與原則”進(jìn)行知識(shí)梳理,為全文的系統(tǒng)論述奠定基礎(chǔ)。 第二部分是我國(guó)自然保護(hù)區(qū)生態(tài)環(huán)境保護(hù)法律問(wèn)題的現(xiàn)狀分析,主要評(píng)介了我國(guó)自然保護(hù)區(qū)的建設(shè)與管理現(xiàn)狀,采取從國(guó)家到地方的順序?qū)ψ匀槐Ｗo(hù)區(qū)的法律現(xiàn)狀進(jìn)行綜述,分析我國(guó)自然保護(hù)區(qū)的法律調(diào)控中存在諸如立法思想、法律位階等典型問(wèn)題。 第三部分是山西省自然保護(hù)區(qū)生態(tài)環(huán)境保護(hù)現(xiàn)狀的法學(xué)分析。通過(guò)數(shù)據(jù)分析和個(gè)案調(diào)查,總結(jié)歸納山西省自然保護(hù)區(qū)的成績(jī)與問(wèn)題、缺點(diǎn)與不足,并簡(jiǎn)要分析原因。 第四部分是域外自然保護(hù)區(qū)生態(tài)環(huán)境保護(hù)的法律實(shí)踐對(duì)山西的啟示。通過(guò)對(duì)美國(guó),日本,加拿大等國(guó)家和地區(qū)自然保護(hù)區(qū)法律制度的介紹和分析,提煉其對(duì)山西自然保護(hù)區(qū)可資借鑒的經(jīng)驗(yàn)。 第五部分是山西省自然保護(hù)區(qū)生態(tài)環(huán)境保護(hù)法律制度的完善。根據(jù)以上分析,提出完善山西省自然保護(hù)區(qū)法律制度的一些合理的設(shè)想。
