【摘要】：環(huán)境侵權(quán)具有特殊性,如加害人的不確定性、侵害對(duì)象的社會(huì)廣泛性以及因損害后果的發(fā)生通常借助于環(huán)境要素這一媒介,故造成受害人人身、財(cái)產(chǎn)損失的同時(shí),也導(dǎo)致社會(huì)治理環(huán)境成本提高等。僅依靠無(wú)過(guò)錯(cuò)責(zé)任原則追究加害人的責(zé)任將無(wú)法對(duì)受害人進(jìn)行及時(shí)、有效的救濟(jì)。所以,通過(guò)建立環(huán)境侵權(quán)損害賠償社會(huì)化分擔(dān)機(jī)制對(duì)損害進(jìn)行賠償救濟(jì),成為環(huán)境保護(hù)法制建設(shè)亟待解決的問(wèn)題。環(huán)境侵權(quán)損害賠償社會(huì)化分擔(dān)機(jī)制將環(huán)境侵權(quán)產(chǎn)生的損害視為社會(huì)損害,通過(guò)設(shè)立環(huán)境責(zé)任保險(xiǎn)、環(huán)境損害賠償基金以及其他配套措施等制度,給予受害人及時(shí)、有效的救濟(jì)。
[Abstract]:Environmental tort has its particularity, such as the uncertainty of the perpetrator, the social universality of the object of infringement and the occurrence of damage consequences usually with the help of the medium of environmental elements, which results in the loss of the victim's person and property at the same time. It also leads to the increase of the cost of social governance environment, and so on. Only relying on the principle of no-fault liability to investigate the responsibility of the perpetrator will not be able to provide timely and effective relief to the victims. Therefore, it is an urgent problem to solve the problem of environmental protection legal system construction by establishing the socialized sharing mechanism of environmental tort damage compensation. The socialized sharing mechanism of environmental tort compensation regards the damage caused by environmental tort as social damage. Through the establishment of environmental liability insurance, environmental damage compensation fund and other supporting measures, the victims can be given timely and effective relief.
