【摘要】：我國可再生能源立法處于起步階段,且尚未形成體系。隨著我國可再生能源開發(fā)利用規(guī)模與水平的提高,有關可再生能源的法律問題會日益增多。我國應當借鑒美國等國家的立法經驗,結合我國國情,建立以《可再生能源法》為基礎、以各類可再生能源技術專門立法與地方立法為主干、以其他相關立法和政策為補充的可再生能源法律體系,為我國可再生能源開發(fā)利用及其衍生問題進行必要的立法與制度儲備;同時修改和完善相關立法和制度為可再生能源的發(fā)展提供制度支持或者掃清制度障礙。
[Abstract]:China's renewable energy legislation is in its infancy and has not yet formed a system. With the improvement of the scale and level of renewable energy development and utilization in China, the legal problems related to renewable energy will increase day by day. China should draw lessons from the legislative experience of the United States and other countries, combine the national conditions of our country, establish the Renewable Energy Law as the foundation, and take the special legislation and local legislation of all kinds of renewable energy technologies as the backbone. The legal system of renewable energy, supplemented by other relevant legislation and policies, will make necessary legislative and institutional reserves for the development and utilization of renewable energy and its derivative problems in China; At the same time, the relevant legislation and system should be amended and perfected to provide institutional support for the development of renewable energy or to clear up institutional barriers.
