【摘要】："限塑令"的出臺體現(xiàn)了治理"白色污染"的需要,然而,它忽略了社會規(guī)范的作用,難以獲得公眾的信仰,以致在實施過程中步履維艱。"限塑令"提高了執(zhí)法成本、增加了交易費用,并為尋租提供了條件,面臨被"架空"的命運。通過行政規(guī)制實現(xiàn)"限塑"相對于其他方式具有優(yōu)越性。要實現(xiàn)"限塑"的目標(biāo),從目前來看,在生產(chǎn)環(huán)節(jié)需要對生產(chǎn)商征收污染稅,在銷售環(huán)節(jié)需要確立塑料袋押金制;從長遠(yuǎn)來看,則需要尋求環(huán)保而且低廉的替代品。對"限塑令"的分析提供了法律如何避免被"架空"的啟示:應(yīng)當(dāng)充分關(guān)注社會規(guī)范,法律特別是控制有害行為的法律必須進行成本一收益分析,重視對意識形態(tài)的投入,從而確保一部法律能夠增進社會福利。
[Abstract]:The introduction of the "plastic restraint order" reflects the need to control "white pollution", but it ignores the role of social norms and is difficult to gain public belief, making it difficult to carry out the process. " Plastic restriction increases the cost of law enforcement, increases transaction costs, and provides conditions for rent-seeking, and faces the fate of being "elevated". Through administrative regulation to achieve "plastic limit" relative to other ways have advantages. In order to achieve the goal of "plastic restraint", pollution tax should be levied on producers in the production link, plastic bag deposit should be established in the sales link, and environmentally friendly and inexpensive alternatives should be sought in the long run. The analysis of "limited plastic order" provides the enlightenment of how the law can avoid being "elevated": we should pay full attention to social norms, and the law, especially the law of controlling harmful behavior, must carry out cost-benefit analysis and attach importance to the input of ideology. Thus ensuring that a law promotes social welfare.
