【摘要】： 目前國際社會對環(huán)境保護日益重視的大環(huán)境下,中國的造船業(yè)發(fā)展迅猛,在世界造船市場上形成“三分天下有其一”之勢。僅手持的訂單份便已上升至全球訂單的17%左右。同時,國內(nèi)的大船東也紛紛定購船舶以擴充運力。雖然目前情況下,我國船舶企業(yè)環(huán)境責任問題未至嚴重凸顯,但基于維護船舶企業(yè)發(fā)展和國家環(huán)境利益、發(fā)展航運經(jīng)濟以及保護海洋和內(nèi)河環(huán)境之考慮,對于船舶企業(yè)環(huán)境責任的研究已是迫在眉睫。加強法律適用等方面問題的調(diào)查和研究,探尋我國亟需制定的適合國情的船舶企業(yè)環(huán)境責任承擔機制成為法學框架下環(huán)境法領域的挑戰(zhàn)之一。 本文除緒論和結論外,共分為四個部分圍繞船舶企業(yè)環(huán)境責任問題進行論述。從船舶企業(yè)環(huán)境責任所應當涉及的基本問題著手,研究船舶企業(yè)、企業(yè)社會責任、企業(yè)環(huán)境責任的一般理論,以及船舶企業(yè)環(huán)境責任承擔與一般環(huán)境責任的比較分析,進一步論述了船舶企業(yè)環(huán)境責任的特殊性所在。從我國實際情況出發(fā),結合我國船舶企業(yè)環(huán)境責任的具體問題,討論船舶企業(yè)環(huán)境責任問題研究具有的現(xiàn)實意義和相當?shù)谋匾?揭示目前船舶企業(yè)存在的環(huán)境污染問題以及該問題產(chǎn)生的后果,并研究了國際相關船舶企業(yè)環(huán)境責任問題的研究成果與相關的法律制度,對各國先進的相關做法進行評介的同時對國際上船舶企業(yè)環(huán)境責任問題的研究特點進行總結,為我國適用國際船舶企業(yè)環(huán)境責任管理模式,找出需要解決的問題和提供法律轉換的技術支撐。 最終,筆者通過研究,對我國船舶企業(yè)環(huán)境責任制度提出了適合我國國情的的構建設想,結合法學視域下對于該問題法律研究的應有理念和應當遵循的基本原則,提出相關立法建議。
[Abstract]:At present, the international community is paying more and more attention to the environment of environmental protection, the shipbuilding industry of China is developing rapidly, forming the trend of "three parts of the world have one" in the world shipbuilding market. Handheld orders alone have risen to about 17% of global orders. At the same time, domestic large shipowners have also ordered ships to expand capacity. Although the problem of environmental responsibility of shipbuilding enterprises in China has not been seriously highlighted at present, in order to safeguard the development of shipping enterprises and the national environmental interests, to develop shipping economy and to protect the marine and inland water environment, It is urgent to study the environmental responsibility of shipbuilding enterprises. It is one of the challenges in the field of environmental law under the framework of law to strengthen the investigation and research on the application of law and to explore the environmental responsibility assumption mechanism of shipbuilding enterprises which is in urgent need of our country. In addition to the introduction and conclusion, this paper is divided into four parts to discuss the environmental responsibility of shipping enterprises. Starting with the basic problems that should be involved in the environmental responsibility of shipbuilding enterprises, this paper studies the general theory of shipbuilding enterprises, corporate social responsibility, corporate environmental responsibility, and the comparative analysis of the assumption of environmental responsibility and general environmental responsibility of shipbuilding enterprises. Furthermore, the particularity of environmental responsibility of shipbuilding enterprises is discussed. Based on the actual situation of our country and the specific problems of environmental responsibility of shipbuilding enterprises in China, this paper discusses the practical significance and necessity of the study on the environmental responsibility of shipbuilding enterprises. This paper reveals the problem of environmental pollution existing in the shipbuilding enterprises and the consequences of the problem, and studies the research results and the relevant legal system of the environmental responsibility of the international shipbuilding enterprises. At the same time, it summarizes the characteristics of the research on the environmental responsibility of the international shipbuilding enterprises, and applies the management mode of the environmental responsibility of the international shipbuilding enterprises to our country. Identify problems to be solved and provide technical support for legal conversion. Finally, through the research, the author puts forward the idea of constructing the environmental responsibility system of the shipbuilding enterprises in our country, combining with the concept of the legal research and the basic principles to be followed in the legal research of this problem under the legal field of law. To put forward relevant legislative suggestions.
