我國(guó)環(huán)境侵權(quán)損害公共補(bǔ)償基金制度研究

【摘要】:環(huán)境侵權(quán)日益復(fù)雜化,其影響所涉及的人數(shù)之多、范圍之廣、時(shí)間之長(zhǎng)是其他侵權(quán)行為難以比擬的,傳統(tǒng)的以個(gè)人責(zé)任為基礎(chǔ)的救濟(jì)方式已不能滿足現(xiàn)代環(huán)境侵權(quán)需求,應(yīng)運(yùn)而生的便是責(zé)任的社會(huì)化、賠償?shù)纳鐣?huì)化。 環(huán)境侵權(quán)損害公共補(bǔ)償基金制度即是一種新興的的社會(huì)化救濟(jì)方式,其核心是則通過政府征收稅費(fèi)、潛在的污染企業(yè)提供資金、財(cái)政撥款及社會(huì)等多種方式籌集形成公共補(bǔ)償基金,受害人在普通民事救濟(jì)求償不能而又無法適用環(huán)境責(zé)任保險(xiǎn)或財(cái)務(wù)擔(dān)保的情況下,才能依環(huán)境侵權(quán)損害公共補(bǔ)償基金制度向相關(guān)部門申請(qǐng)基金補(bǔ)償。環(huán)境侵權(quán)損害公共補(bǔ)償基金制度是對(duì)現(xiàn)有救濟(jì)制度缺陷、空白地帶的補(bǔ)充和完善。 本文綜合運(yùn)用了比較法、價(jià)值分析法、經(jīng)濟(jì)分析法和文獻(xiàn)歸納法等,先分析現(xiàn)行環(huán)境侵權(quán)救濟(jì)制度的局限性,引申出環(huán)境侵權(quán)損害公共補(bǔ)償基金制度,解釋了其具體內(nèi)涵,闡述了其理論基礎(chǔ),并分析了在我國(guó)建立這一制度的必要性。在論文的后半部分,針對(duì)我國(guó)實(shí)際情況,在借鑒國(guó)外相關(guān)經(jīng)驗(yàn)的基礎(chǔ)上,具體構(gòu)建了這一制度。 環(huán)境侵權(quán)損害公共補(bǔ)償基金制度始于上世紀(jì)60年代,時(shí)至今日,該制度在域外已經(jīng)有相當(dāng)?shù)陌l(fā)展,但在我國(guó)目前尚未建立,本文針對(duì)這一制度進(jìn)行深入的研究,意在構(gòu)建我國(guó)環(huán)境損害的公共補(bǔ)償基金制度,以期為我國(guó)建立和完善有關(guān)環(huán)境侵權(quán)損害賠償法律制度研究提供有益參考。
[Abstract]:Environmental tort is becoming more and more complicated, and its influence is more numerous, wider scope and longer time than other tort acts. The traditional relief method based on individual liability can not meet the needs of modern environmental tort. What arises at the historic moment is socialization of responsibility and socialization of compensation. The public compensation fund system for environmental tort damage is a new way of social relief. The core of which is to provide funds through government taxes and fees, which are potentially polluted by enterprises. When the public compensation fund is raised by various means, such as financial allocation and society, the victim is unable to apply the environmental liability insurance or financial guarantee when the ordinary civil relief claim cannot be applied. Only in accordance with the environmental tort damage public compensation fund system to the relevant departments to apply for fund compensation. The public compensation fund system for environmental tort damage is a supplement and perfection to the existing relief system. This article synthetically uses the comparative method, the value analysis method, the economic analysis method and the literature induction method, first analyzes the limitation of the current environmental tort relief system, extends the public compensation fund system for the environmental tort damage, and explains its specific connotation. This paper expounds its theoretical basis and analyzes the necessity of establishing this system in China. In the second half of this paper, according to the actual situation of our country, this system is constructed on the basis of the experience of foreign countries. The system of public compensation fund for environmental tort damage began in the 1960s. Today, the system has been developed abroad, but it has not been established in our country at present. This paper makes a deep research on this system. The purpose of this paper is to construct a public compensation fund system for environmental damage in China, in order to provide a useful reference for the establishment and improvement of the legal system of environmental tort damages compensation in China.
