    前言：環(huán)境問題是人類活動及其影響超出環(huán)境承受能力的極限所造成的后果。解決環(huán)境問題最根本的辦法是分配 ,即把有限的環(huán)境資源在人類廣泛的欲求之間做“相持而長”的分配。這種資源分配不同于收益分配 ,它體現(xiàn)的基本精神是義務(wù)。把體現(xiàn)義務(wù)精神的分配方法引入環(huán)境立法 ,必然導致環(huán)境法由傳統(tǒng)的權(quán)利本位轉(zhuǎn)變?yōu)榱x務(wù)本位。環(huán)境法不得不采用資源分配的辦法 ,以義務(wù)為本位 ,這是由環(huán)境這種特殊的物質(zhì)條件所決定的
    Environmental problems are caused by human's act ivities and their influences , which go beyond the limit of environment. The basic method to solve environme ntal problems is through allotment, that is to allot the limited environmental r esources among the broad human desires and demands.
