【摘要】：循環(huán)經(jīng)濟(jì)倡導(dǎo)對(duì)資源進(jìn)行優(yōu)化合理的循環(huán)利用,以求實(shí)現(xiàn)經(jīng)濟(jì)、社會(huì)與資源和諧的理想狀態(tài)。發(fā)展循環(huán)經(jīng)濟(jì)是堅(jiān)持可持續(xù)發(fā)展戰(zhàn)略的重要舉措,循環(huán)經(jīng)濟(jì)發(fā)展模式是人類在推動(dòng)經(jīng)濟(jì)社會(huì)穩(wěn)步向前的過程當(dāng)中,為解決資源與環(huán)境問題,協(xié)調(diào)經(jīng)濟(jì)發(fā)展和生態(tài)保護(hù)的關(guān)系而探尋出的一種新型發(fā)展模式。隨著可持續(xù)發(fā)展理念的深化,循環(huán)經(jīng)濟(jì)發(fā)展模式已經(jīng)得到了許多國(guó)家的公認(rèn)。在我國(guó)經(jīng)濟(jì)社會(huì)快速發(fā)展的過程當(dāng)中,資源與環(huán)境形勢(shì)都面臨著嚴(yán)峻挑戰(zhàn),永續(xù)發(fā)展也已經(jīng)納入國(guó)家發(fā)展戰(zhàn)略。《循環(huán)經(jīng)濟(jì)促進(jìn)法》的頒布和實(shí)施為我國(guó)循環(huán)經(jīng)濟(jì)的發(fā)展提供了制度依據(jù),但是我國(guó)的循環(huán)經(jīng)濟(jì)法律體系還不完善,循環(huán)經(jīng)濟(jì)發(fā)展規(guī)劃制度不健全,生產(chǎn)者責(zé)任延伸制度的生產(chǎn)者延伸責(zé)任和主體界定不清晰,循環(huán)經(jīng)濟(jì)責(zé)任分擔(dān)制度系統(tǒng)性較差,循環(huán)經(jīng)濟(jì)信息公開制度不完備,循環(huán)經(jīng)濟(jì)監(jiān)管制度不健全,這些問題都不利于我國(guó)循環(huán)經(jīng)濟(jì)的有序快速發(fā)展。因而,我們應(yīng)當(dāng)秉承可持續(xù)發(fā)展觀,立足于當(dāng)前實(shí)際,進(jìn)一步完善我國(guó)的循環(huán)經(jīng)濟(jì)法律制度。本文簡(jiǎn)要介紹了循環(huán)經(jīng)濟(jì)的內(nèi)涵、產(chǎn)生和發(fā)展,闡明了我國(guó)循環(huán)經(jīng)濟(jì)法律制度的概況,剖析了當(dāng)前存在的問題,同時(shí)考察了德國(guó)、美國(guó)和日本的循環(huán)經(jīng)濟(jì)法律制度,對(duì)完善我國(guó)循環(huán)經(jīng)濟(jì)法律制度提出了詳細(xì)的可行性建議。完善我國(guó)循環(huán)經(jīng)濟(jì)法律體系,要建全專項(xiàng)立法,要加快制定并公布強(qiáng)制回收名錄與管理辦法;健全循環(huán)經(jīng)濟(jì)發(fā)展規(guī)劃制度,擴(kuò)大發(fā)展規(guī)劃的制定主體范圍,增設(shè)發(fā)展規(guī)劃制定和審議年限的規(guī)定;明確生產(chǎn)者責(zé)任延伸制度中生產(chǎn)者的延伸責(zé)任和主體;增強(qiáng)循環(huán)經(jīng)濟(jì)責(zé)任分擔(dān)制度的系統(tǒng)性;改進(jìn)循環(huán)經(jīng)濟(jì)信息公開制度,擴(kuò)大信息公開的主體范圍和內(nèi)容;建全循環(huán)經(jīng)濟(jì)監(jiān)管制度,明確執(zhí)法主體,建立監(jiān)督的多維視角。
[Abstract]:Circular economy advocates optimal and rational recycling of resources in order to achieve a harmonious ideal state of economy, society and resources. The development of circular economy is an important measure to adhere to the strategy of sustainable development. The development model of circular economy is to solve the problems of resources and environment in the process of promoting the steady progress of economic society. A new development model is explored by coordinating the relationship between economic development and ecological protection. With the deepening of the concept of sustainable development, circular economy development model has been recognized by many countries. In the process of rapid economic and social development in China, the situation of resources and environment is facing severe challenges. Sustainable development has also been incorporated into the national development strategy. The promulgation and implementation of the Circular economy Promotion Law provides an institutional basis for the development of circular economy in China, but the legal system of circular economy in our country is not perfect. The planning system of circular economy development is not perfect, the extended producer responsibility and the definition of main body of producer responsibility extension system are not clear, the system of sharing responsibility in circular economy is poor, and the system of disclosure of circular economy information is not complete. These problems are not conducive to the rapid and orderly development of circular economy in China. Therefore, we should uphold the concept of sustainable development, based on the current reality, and further improve our legal system of circular economy. This paper briefly introduces the connotation, emergence and development of circular economy, expounds the general situation of the legal system of circular economy in China, analyzes the existing problems, and examines the legal system of circular economy in Germany, the United States and Japan. The paper puts forward detailed feasible suggestions to perfect the legal system of circular economy in China. To improve the legal system of circular economy in China, it is necessary to establish and complete special legislation, to speed up the formulation and publication of compulsory recycling lists and management measures, to improve the planning system for the development of circular economy, and to expand the scope of the main body for making development plans. To add provisions for the formulation and review of the number of years of development planning; to clarify the extended responsibility and subject of producers in the extended system of producer responsibility; to enhance the systematization of the system of sharing responsibility in circular economy; to improve the disclosure system of information on circular economy; Expanding the scope and content of the subject of information disclosure, establishing the supervision system of circular economy, clarifying the subject of law enforcement, and establishing the multi-dimensional perspective of supervision.
