水資源可持續(xù)利用法律制度研究

【摘要】：水資源是基礎(chǔ)性的自然資源和戰(zhàn)略性的經(jīng)濟(jì)資源,水資源是經(jīng)濟(jì)發(fā)展、社會穩(wěn)定和人民生活不可缺少、不可替代的重要物質(zhì),是經(jīng)濟(jì)社會可持續(xù)發(fā)展的重要保障。同時,我們應(yīng)該看到,由于人類對水資源的過度開發(fā)和濫用,使得水資源正面臨枯竭的危險,因此,世界上不少國家和國際組織采用法律手段對水資源實施保護(hù)和管理。隨著經(jīng)濟(jì)和社會的不斷發(fā)展,合理開發(fā)利用水資源,特別是依法保護(hù)和管理水資源,如何能在不破壞水生態(tài)系統(tǒng)平衡的前提下進(jìn)行開發(fā),保障水資源能夠源源不斷的為人類永續(xù)利用,已成為世界各國所共同面臨的一個課題。水資源的可持續(xù)利用已經(jīng)成為經(jīng)濟(jì)社會可持續(xù)發(fā)展的基礎(chǔ)性、全局性和戰(zhàn)略性問題。 我國作為一個發(fā)展中國家,在計劃經(jīng)濟(jì)時代,長期將水資源作為無價物進(jìn)行計劃分配,造成了嚴(yán)重的水資源濫用和浪費(fèi)現(xiàn)象,其影響至今還依然存在。目前,我國水資源狀況值得憂慮,水質(zhì)量不斷下降,水環(huán)境持續(xù)惡化,水污染事故不斷發(fā)生,另一方面,水資源的利用效率低下,存在著嚴(yán)重的浪費(fèi),又進(jìn)一步加劇了水資源的短缺。為規(guī)范人們開發(fā)、利用水資源的行為,保持水生態(tài)系統(tǒng)的平衡,必須構(gòu)建一套科學(xué)合理的水資源可持續(xù)利用法律制度。但是我國現(xiàn)行法律體系中關(guān)于水資源可持續(xù)利用問題的規(guī)定還很欠缺,亟待完善。 本文共由五部分內(nèi)容組成。第一章緒論部分,簡要介紹了選題背景、研究目的和意義、國內(nèi)外研究現(xiàn)狀、研究思路與方法；第二章概述部分從我國水資源的現(xiàn)狀出發(fā),強(qiáng)調(diào)實現(xiàn)水資源可持續(xù)利用的重要性；第三章通過對可持續(xù)發(fā)展理論的內(nèi)涵和本質(zhì)的全面介紹,分析可持續(xù)發(fā)展和水資源的相互關(guān)系,明確了水資源可持續(xù)利用是經(jīng)濟(jì)社會可持續(xù)發(fā)展的重要內(nèi)容,得出我國堅持走水資源可持續(xù)利用道路是歷史的必然選擇。第四章通過對國外水資源可持續(xù)利用法律制度的分析比較,吸取合理的部分,為我國水資源可持續(xù)利用法律制度的建立提供可借鑒之處。第五章是本文的中心內(nèi)容,通過介紹國內(nèi)水權(quán)制度研究的最新成果,對我國新《水法》的立法目的和思想、制度設(shè)計和具體內(nèi)容進(jìn)行分析和評價,提出構(gòu)建我國水資源可持續(xù)利用的法律制度。以可持續(xù)發(fā)展思想為指導(dǎo),進(jìn)一步健全水資源法律法規(guī),建立明確的水資源流域管理制度,建立水權(quán)制度,確立公眾參與機(jī)制,為實現(xiàn)水資源的可持續(xù)利用提供可靠的法律保障。 總之,我國水資源可持續(xù)利用必須以可持續(xù)發(fā)展思想為指導(dǎo),從法律層面探索水資源可持續(xù)利用的法律制度,才能最終實現(xiàn)社會經(jīng)濟(jì)、資源和環(huán)境的協(xié)調(diào)發(fā)展。
[Abstract]:Water resources are basic natural resources and strategic economic resources. Water resources are an indispensable and irreplaceable important material for economic development, social stability and people's life, and an important guarantee for sustainable economic and social development. At the same time, we should see that, due to the over-exploitation and abuse of water resources, water resources are facing the danger of exhaustion. Therefore, many countries and international organizations in the world adopt legal means to protect and manage water resources. With the continuous development of economy and society, how to develop and utilize water resources rationally, especially in the protection and management of water resources according to law, without destroying the balance of water ecosystem, The protection of water resources can be continuously used for mankind, has become a common problem in the world. The sustainable utilization of water resources has become the basic, overall and strategic problem of sustainable economic and social development. China, as a developing country, in the planned economy era, the long-term allocation of water resources as a priceless, caused a serious abuse and waste of water resources, its impact still exists. At present, the situation of water resources in our country is worth worrying, the water quality is declining, the water environment continues to deteriorate, the water pollution accidents continue to occur, on the other hand, the utilization efficiency of water resources is low, and there is serious waste. It further exacerbates the shortage of water resources. In order to standardize the behavior of water resources exploitation and maintain the balance of water ecosystem, it is necessary to construct a scientific and reasonable legal system for sustainable utilization of water resources. However, the regulations on the sustainable utilization of water resources in the current legal system of our country are still lacking and need to be improved. This paper consists of five parts. The first chapter introduces the background of the topic, the purpose and significance of the research, the status quo of the research at home and abroad, the research ideas and methods, and the second chapter summarizes the current situation of water resources in China. Emphasizing the importance of achieving the sustainable use of water resources and, in chapter III, analysing the interrelationship between sustainable development and water resources through a comprehensive introduction of the connotation and nature of the theory of sustainable development, It is clear that the sustainable utilization of water resources is an important part of the sustainable development of economy and society, and it is concluded that it is an inevitable choice of history for our country to stick to the road of sustainable utilization of water resources. The fourth chapter, through the analysis and comparison of the legal system of the sustainable utilization of water resources abroad, draws on the reasonable part, and provides some references for the establishment of the legal system of the sustainable utilization of water resources in China. The fifth chapter is the central content of this paper. Through introducing the latest achievements of the domestic water rights system, the author analyzes and evaluates the legislative purpose and thought, system design and concrete content of the new water law in China. The legal system of sustainable utilization of water resources in China is put forward. Under the guidance of the idea of sustainable development, we should further improve the laws and regulations of water resources, establish a clear water basin management system, establish a water rights system, and establish a mechanism for public participation. To achieve the sustainable use of water resources to provide reliable legal protection. In short, the sustainable utilization of water resources in China must be guided by the idea of sustainable development and explore the legal system of sustainable use of water resources from the legal level, in order to realize the harmonious development of social economy, resources and environment.
