【摘要】：改革開放以來,我國經(jīng)濟(jì)高速發(fā)展的同時(shí)也帶來嚴(yán)峻的環(huán)境污染形勢。環(huán)境與健康問題變得越來越突出。為防治環(huán)境污染,保護(hù)群眾健康,我國制定了一系列環(huán)境與健康相關(guān)的法律法規(guī)。立法評估工作近年在我國積極開展,對環(huán)境與健康立法體系的整體性評估是現(xiàn)有研究的一個(gè)薄弱環(huán)節(jié)。 本論文闡述了選題的背景和目的,總結(jié)了我國在環(huán)境與健康領(lǐng)域相關(guān)法律法規(guī)的現(xiàn)狀,簡要介紹了國外主要國家和地區(qū)環(huán)境與健康的立法狀況。本論文在歸納和總結(jié)國內(nèi)外立法評估方面相關(guān)方法的基礎(chǔ)上,提出了立法要素比較分析的評估方法,對環(huán)境與健康法律體系中關(guān)鍵要素進(jìn)行分析評估。通過對國內(nèi)外環(huán)境與健康立法的立法目的、立法廣度、管理體制、制度措施、技術(shù)標(biāo)準(zhǔn)、法律責(zé)任六個(gè)關(guān)鍵要素的分析對比,并在廣泛查閱相關(guān)要素研究文獻(xiàn)的基礎(chǔ)上,對各個(gè)要素進(jìn)行分析評估,最終得出我國環(huán)境與健康相關(guān)法律法規(guī)的評估結(jié)果如下：(1)環(huán)境立法未樹立保護(hù)健康的中心目的；(2)環(huán)境法中缺少健康保護(hù)的內(nèi)容,缺少環(huán)境與健康方面的專門立法；(3)環(huán)境與健康管理在國家和地方層面都相互分離,缺乏有效的協(xié)調(diào)機(jī)制；(4)制度措施方面,已建立相對完善的環(huán)境監(jiān)測和環(huán)境影響評價(jià)制度,但缺乏相應(yīng)的健康監(jiān)測和環(huán)境健康影響評價(jià)制度,未建立環(huán)境健康損害賠償制度,其他制度也存在一定的缺陷；(5)標(biāo)準(zhǔn)體系相對完善,但在標(biāo)準(zhǔn)的定位、覆蓋面以及先進(jìn)性、協(xié)調(diào)性方面存在不足；(6)法律責(zé)任的設(shè)置上存在著違法成本低的現(xiàn)象,對環(huán)境違法行為的震懾力度不夠。最后,針對評估的結(jié)果,本文提出了完善我國環(huán)境與健康法律法規(guī)體系的對策與建議：(1)改造我國環(huán)境立法的目的,樹立以保障健康為中心的立法理念；(2)完善我國環(huán)境與健康立法體系,擴(kuò)大環(huán)境法的覆蓋面,盡早出臺我國環(huán)境與健康方面的專門立法；(3)出臺環(huán)境與健康管理機(jī)構(gòu)的組織法,明確各部門的職責(zé)分工及協(xié)調(diào)機(jī)制；(4)彌補(bǔ)現(xiàn)有制度措施的不足,加強(qiáng)現(xiàn)有制度措施與健康保護(hù)的聯(lián)系；(5)完善我國環(huán)境與健康標(biāo)準(zhǔn)體系；(6)強(qiáng)化違法行為的法律責(zé)任,加大對環(huán)境違法行為的處罰力度。
[Abstract]:Since the reform and opening up, China's rapid economic development has also brought severe environmental pollution. Environmental and health problems have become increasingly prominent. In order to prevent and control environmental pollution and protect the health of the masses, China has formulated a series of laws and regulations related to environment and health. In recent years, the legislative evaluation has been carried out actively in China, and the holistic evaluation of the environmental and health legislative system is a weak link in the existing research. This paper describes the background and purpose of the topic, summarizes the current situation of laws and regulations in the field of environment and health in China, and briefly introduces the legislation status of environment and health in major countries and regions abroad. On the basis of summing up and summarizing the relevant methods of legislative evaluation at home and abroad, this paper puts forward a comparative analysis method of legislative elements, and analyzes and evaluates the key elements in the legal system of environment and health. Based on the analysis and comparison of the legislative purpose, legislative breadth, management system, system measures, technical standards and legal liability of the environmental and health legislation at home and abroad, and on the basis of extensive reference to the relevant factors research literature, this paper analyzes and compares the six key elements of environmental and health legislation at home and abroad. Through the analysis and evaluation of each element, the evaluation results of the laws and regulations related to environment and health in China are as follows: (1) the environmental legislation does not establish the central purpose of protecting health; (2) the content of health protection is lacking in environmental law. Lack of specific legislation on environment and health; (III) separation of environment and health management at the national and local levels and lack of effective coordination mechanisms; and (iv) relatively sound environmental monitoring and environmental impact assessment systems have been established for institutional measures, However, it lacks the corresponding health monitoring and environmental health impact assessment system, does not establish the environmental health damage compensation system, and other systems also have some defects; (5) the standard system is relatively perfect, but in the standard positioning, coverage and advanced, (6) the establishment of legal liability has the phenomenon of low cost, and the deterrent to environmental illegal behavior is not strong enough. Finally, according to the results of the evaluation, this paper puts forward the countermeasures and suggestions to perfect the laws and regulations system of environment and health in our country: (1) to reform the purpose of environmental legislation in China, and to set up the legislation idea centered on the protection of health; (2) perfect the legislation system of environment and health in our country, expand the coverage of environmental law, introduce the special legislation on environment and health as soon as possible, (3) introduce the organic law of environmental and health management organization, clarify the division of responsibilities and coordination mechanism of various departments; (4) to make up for the deficiency of existing system measures, to strengthen the link between existing system measures and health protection; (5) to perfect the system of environmental and health standards in China; (6) to strengthen the legal liability of illegal acts and to increase the punishment of environmental illegal acts.
