【摘要】：汽車在給人們帶來極大交通便利的同時,也對人體和大氣環(huán)境造成了嚴(yán)重的危害。在我國大陸,由于汽車保有量及需求量增長迅速,而目前的排放法規(guī)對汽車尾氣排放要求相對寬松,汽車整體性能和路況又相對較差,加之我們的執(zhí)法部門執(zhí)法能力較低,所以造成了汽車尾氣污染嚴(yán)重的局面。盡管我國香港特別行政區(qū)在其發(fā)展過程中也曾有過汽車尾氣污染嚴(yán)重的階段,但其通過建立完善的法律控制體系,實(shí)施有效的控制措施,目前已經(jīng)取得了顯著成效。 香港汽車尾氣污染法律控制體系整體運(yùn)行的有效性,離不開香港所擁有的一個高效的環(huán)境保護(hù)法律體系,這一體系以多部門共同參與、垂直管理和社會監(jiān)督配合作為主要的內(nèi)容,并以行政主導(dǎo)、依法行政和政企合作作為基本原則。具體到香港汽車尾氣污染法律控制體系而言,它的主要內(nèi)容包括作為核心和依據(jù)的相關(guān)法律條款、多樣化的執(zhí)法措施和有效的經(jīng)濟(jì)刺激手段。在環(huán)境立法、環(huán)境執(zhí)法和司法救濟(jì)三個層面,大陸現(xiàn)有的污染控制體系都極不完善。因此,從法律監(jiān)管、交通管理、稅收改革和公民環(huán)保意識培養(yǎng)四個方面對香港先進(jìn)做法進(jìn)行功能性借鑒,對于大陸減少尾氣污染,建設(shè)環(huán)境友好型社會具有十分顯著的意義。
[Abstract]:Automobile not only brings great traffic convenience to people, but also causes serious harm to human body and atmospheric environment. In mainland China, due to the rapid growth of vehicle ownership and demand, the current emission regulations have relatively loose requirements on vehicle exhaust emissions, and the overall performance and road conditions of the vehicles are relatively poor. In addition, our law enforcement departments have a relatively low ability to enforce the law. As a result, car exhaust pollution is serious. Although the Hong Kong Special Administrative region of China has had a serious stage of automobile exhaust pollution in its development process, it has achieved remarkable results by establishing a perfect legal control system and implementing effective control measures. The effectiveness of the overall operation of the legal control system for automobile exhaust pollution in Hong Kong is inseparable from the highly efficient legal system of environmental protection in Hong Kong, which is jointly participated by various departments. The cooperation of vertical management and social supervision is the main content, with the administrative leading, the administration according to law and the cooperation between government and enterprise as the basic principle. As for the legal control system of automobile exhaust pollution in Hong Kong, its main contents include relevant legal provisions as the core and basis, diversified enforcement measures and effective economic incentives. In the three levels of environmental legislation, environmental law enforcement and judicial relief, the existing pollution control system in mainland China is very imperfect. Therefore, it is of great significance for the mainland to reduce tail gas pollution and build an environment-friendly society from the four aspects of legal supervision, traffic management, tax reform and the cultivation of citizens' environmental awareness.
