【摘要】：低碳經(jīng)濟是一種以能源的清潔開發(fā)與高效利用為基礎(chǔ),以低能耗、低排放為基本經(jīng)濟特征、順應(yīng)可持續(xù)發(fā)展理念和控制溫室氣體排放要求的社會經(jīng)濟發(fā)展模式。 隨著氣候問題的升溫,全球各國都開始對以往的經(jīng)濟發(fā)展模式進(jìn)行反思。生態(tài)問題、環(huán)境問題、人與社會的和諧發(fā)展問題已經(jīng)越來越受到重視,發(fā)展低碳經(jīng)濟已成為全人類共同的選擇。中國作為最大的發(fā)展中國家,也是全球碳排放量最大的國家之一。發(fā)展低碳經(jīng)濟,如果沒有中國的積極參與,氣候問題就無法得到很好的解決。全球?qū)Φ吞冀?jīng)濟的關(guān)注日益增強,給中國提供了贏得競爭力、國際聲譽和環(huán)境效益的良機。發(fā)展低碳經(jīng)濟,造福子孫后代,符合中國實現(xiàn)可持續(xù)發(fā)展、實現(xiàn)和諧社會的要求。 本文在總結(jié)國外發(fā)展低碳經(jīng)濟的法律和政策研究基礎(chǔ)上,重點分析了我國發(fā)展低碳經(jīng)濟的法律與政策,并提出了我國發(fā)展低碳經(jīng)濟的法律和政策建議。全文共分為五部分:第一部分闡述了全球氣候變暖已成為人類面臨的重大問題,進(jìn)入21世紀(jì)后,發(fā)展低碳經(jīng)濟已成為國際社會的選擇;第二部分論述了我國發(fā)展低碳經(jīng)濟的必要性;第三部分分析研究了美國、英國、日本、意大利等國的發(fā)展低碳經(jīng)濟的法律與政策,綜合分析國際社會發(fā)展低碳經(jīng)濟的政策和法律手段,探索適合發(fā)展我國低碳經(jīng)濟的途徑;第四部分闡述了我國現(xiàn)行的與低碳經(jīng)濟相關(guān)的法律政策,分析其存在的合理性及缺陷;第五部分是在以上研究的基礎(chǔ)上提出發(fā)展我國低碳經(jīng)濟的法律建議。即:完善《環(huán)境保護(hù)法》等相關(guān)法律規(guī)定;盡快制定應(yīng)對氣候變化的法律;征收碳稅;以及將《可再生能源法》設(shè)定的各項義務(wù)與相關(guān)法律政策銜接等建議。
[Abstract]:Low-carbon economy is a kind of social and economic development model based on clean development and efficient utilization of energy, low energy consumption and low emission as the basic economic characteristics, conforming to the concept of sustainable development and controlling greenhouse gas emissions. With the warming of climate problems, countries around the world began to reflect on the past economic development model. Ecological problems, environmental problems and harmonious development between human beings and society have been paid more and more attention. The development of low-carbon economy has become the common choice of all mankind. As the largest developing country, China is also one of the largest carbon emitters in the world. The development of low-carbon economy, without China's active participation, the climate problem can not be solved very well. The growing global focus on a low-carbon economy offers China an opportunity to win competitiveness, international reputation and environmental benefits. The development of low-carbon economy for the benefit of future generations is in line with the requirements of achieving sustainable development and a harmonious society in China. On the basis of summing up the research on the laws and policies of developing low-carbon economy in foreign countries, this paper focuses on the analysis of the laws and policies of developing low-carbon economy in China, and puts forward some legal and policy suggestions for the development of low-carbon economy in China. The paper is divided into five parts: the first part expounds that global warming has become a major problem facing mankind. After entering the 21st century, the development of low-carbon economy has become the choice of the international community; The second part discusses the necessity of developing low-carbon economy in China, the third part analyzes the laws and policies of the United States, Britain, Japan, Italy and other countries to develop low-carbon economy. Comprehensive analysis of the international community to develop low-carbon economy policy and legal means to explore suitable for the development of low-carbon economy in China the fourth part of the current low-carbon economy related to the legal policy analysis of the existence of its rationality and defects; The fifth part is on the basis of the above research put forward the development of low-carbon economy in China legal recommendations. That is, perfecting the relevant laws and regulations such as the Environmental Protection Law; making laws to deal with climate change as soon as possible; collecting carbon tax; and linking up the obligations set by the Renewable Energy Law with relevant laws and policies.
