【摘要】：生態(tài)文明要求環(huán)境法反映環(huán)境保護(hù)的本質(zhì),以實(shí)現(xiàn)人與自然和諧的目標(biāo)。不法行為懲罰主義的環(huán)境法以行為人"不犯"為直接規(guī)制目標(biāo),無法控制由不同環(huán)境消費(fèi)者實(shí)施的總行為;總行為控制制度以控制總行為作為法律的直接規(guī)制目標(biāo),可以控制總影響,便于實(shí)現(xiàn)既定的控制目標(biāo),但這種制度下的總行為控制邊界不一定符合環(huán)境保護(hù)的實(shí)際需要。環(huán)境質(zhì)量目標(biāo)主義主張把環(huán)境質(zhì)量目標(biāo)確定為法律的直接規(guī)制目標(biāo),并根據(jù)環(huán)境質(zhì)量目標(biāo)的要求構(gòu)建環(huán)境法。環(huán)境質(zhì)量目標(biāo)主義環(huán)境法是環(huán)保目標(biāo)先定的法、政府負(fù)責(zé)的法、服從科學(xué)的法,既便于實(shí)現(xiàn)立法確定的環(huán)境保護(hù)目標(biāo),又能使法定的環(huán)境保護(hù)目標(biāo)更符合人與自然和諧的要求。環(huán)境質(zhì)量目標(biāo)主義環(huán)境法的制度主要有環(huán)境質(zhì)量標(biāo)準(zhǔn)制度、環(huán)境決策制度、環(huán)境規(guī)劃制度和環(huán)境質(zhì)量及環(huán)保業(yè)績?cè)u(píng)估制度等。
[Abstract]:Ecological civilization requires environmental law to reflect the nature of environmental protection in order to achieve the goal of harmony between man and nature. The law of punishment of illegal act takes "not infringing" as the direct regulation target, and can not control the total behavior carried out by consumers in different environments, and the total behavior control system takes the control of general behavior as the direct regulation target of law. The total effect can be controlled and the established control goal can be achieved, but the general behavior control boundary under this system does not necessarily meet the actual needs of environmental protection. Environmental quality objectivism advocates that the environmental quality goal should be defined as the direct regulation objective of law, and the environmental law should be constructed according to the requirement of environmental quality goal. Environmental quality objectivism Environmental law is the law of environmental protection objectives, the law that the government is responsible for, and obey the scientific law, is not only convenient to realize the environmental protection target determined by legislation, but also can make the legal environmental protection goal more accord with the requirement of harmony between man and nature. The environmental quality objectivism environmental law system mainly includes the environmental quality standard system, the environment decision-making system, the environment planning system and the environment quality and the environmental performance appraisal system and so on.
