我國(guó)電子廢棄物管理立法研究

【摘要】: 我國(guó)是世界上最大的家用電器生產(chǎn)和消費(fèi)國(guó)之一,如今面臨著越來越嚴(yán)重的電子廢棄物處理的壓力。電子廢棄物具有數(shù)量增長(zhǎng)快、危害大、無害化處理難度大以及回收利用價(jià)值高等特點(diǎn),對(duì)其處理不當(dāng)會(huì)帶來環(huán)境的污染和資源的浪費(fèi),為了適應(yīng)可持續(xù)發(fā)展和建設(shè)和諧社會(huì)的需要,提升我國(guó)的國(guó)際地位,應(yīng)對(duì)即將產(chǎn)生的貿(mào)易壁壘,我國(guó)應(yīng)該對(duì)電子廢棄物管理進(jìn)行立法。發(fā)達(dá)國(guó)家在電子廢棄物的污染防治和資源化方面積累了一定的經(jīng)驗(yàn),并建立了相對(duì)完善的法律法規(guī)體系。本文系統(tǒng)分析了我國(guó)在電子廢棄物回收與處理方面存在的問題與不足,通過借鑒發(fā)達(dá)國(guó)家在政策制度建設(shè)方面的經(jīng)驗(yàn),從系統(tǒng)的角度提出了加強(qiáng)電子廢棄物管理的對(duì)策體系。 論文的核心部分是我國(guó)電子廢棄物管理立法的制度構(gòu)建。污染者負(fù)擔(dān)原則在電子廢棄物處置適用方面存在一定的問題,與之相比,受益者負(fù)擔(dān)原則更能體現(xiàn)環(huán)境正義和公平。通過我國(guó)電子廢棄物處理產(chǎn)業(yè)發(fā)展現(xiàn)狀與發(fā)達(dá)國(guó)家相關(guān)產(chǎn)業(yè)的比較,得出了我國(guó)電子廢棄物回收處理要走產(chǎn)業(yè)化道路的結(jié)論。電子廢棄物回收處理的產(chǎn)業(yè)化依賴于完善回收體系的建設(shè)、競(jìng)爭(zhēng)機(jī)制的引入、準(zhǔn)入制度的確立、回收處理技術(shù)水平的提高以及公眾的參與。國(guó)外電子廢棄物的大量涌入也是造成我國(guó)電子廢棄物污染問題的重要原因,這一問題的解決有賴于我國(guó)環(huán)境刑事立法的完善和打擊電子廢棄物走私措施的加強(qiáng)。
[Abstract]:China is one of the largest household appliances producers and consumers in the world, and now it faces more and more serious pressure of electronic waste disposal. Electronic wastes are characterized by rapid growth of quantity, great harm, difficulty of harmless treatment and high value of recycling. Improper disposal of electronic wastes will bring about environmental pollution and waste of resources. In order to meet the needs of sustainable development and the construction of a harmonious society, to enhance our international status and to cope with the forthcoming trade barriers, our country should legislate on the management of electronic wastes. Developed countries have accumulated some experience in pollution prevention and utilization of electronic wastes, and have established a relatively perfect system of laws and regulations. This paper systematically analyzes the problems and deficiencies in the recovery and disposal of electronic wastes in China, and puts forward a countermeasure system for strengthening the management of electronic wastes from the point of view of the system by drawing lessons from the experience of the developed countries in the construction of policies and systems. The core part of this paper is the system construction of electronic waste management legislation in China. The polluter burden principle has some problems in the application of electronic waste disposal, compared with the beneficiary burden principle, it can embody environmental justice and equity. By comparing the present situation of electronic waste disposal industry in China with the related industries in developed countries, the conclusion is drawn that the recycling and disposal of electronic waste in China should follow the road of industrialization. The industrialization of electronic waste recovery and treatment depends on the construction of perfect recycling system, the introduction of competition mechanism, the establishment of access system, the improvement of recovery and treatment technology and the participation of the public. The influx of foreign electronic wastes is also an important reason for the problem of electronic waste pollution in China. The solution of this problem depends on the improvement of our country's environmental criminal legislation and the strengthening of measures to crack down on the smuggling of electronic wastes.
