【摘要】：《礦產(chǎn)資源法》中的"權(quán)"和"證"主要是指礦業(yè)權(quán)和行政權(quán),如何處理"權(quán)"與"證"的關(guān)系是現(xiàn)行《礦產(chǎn)資源法》修改中所面臨的基礎(chǔ)性問題。現(xiàn)行《礦產(chǎn)資源法》中"權(quán)證合一"的立法模式不僅在理論上難以自圓其說而且在實踐中也存在諸多弊端。在《礦產(chǎn)資源法》以"權(quán)證分開"的立法模式取代現(xiàn)行"權(quán)證合一"模式在理論上具有充分的合理性,在具體的制度設(shè)計方面也具可行性。
[Abstract]:The "rights" and "certificates" in the Mineral Resources Law mainly refer to the mining rights and administrative powers. How to deal with the relationship between "rights" and "certificates" is the basic problem in the revision of the present Mineral Resources Law. The legislative model of "the combination of warrants and warrants" in the present Mineral Resources Law is not only difficult to justify itself in theory but also has many drawbacks in practice. In "Mineral Resources Law", it is reasonable in theory to replace the current mode of "combination of warrants and warrants" with the legislative model of "separation of warrants", and it is also feasible in the aspect of specific system design.
