【摘要】：隨著我國(guó)經(jīng)濟(jì)的繁榮,需要越來(lái)越多的船舶營(yíng)運(yùn),我國(guó)所面臨的船舶污染事故風(fēng)險(xiǎn)始終存在。船舶污染事故造成的后果嚴(yán)重并且難以消除。一套專業(yè)的調(diào)查處理船舶污染事故的機(jī)制不僅可以盡可能消除事故本身所帶來(lái)的危害,更可以使相關(guān)機(jī)關(guān)可以在事故中吸取教訓(xùn),改善調(diào)查機(jī)制,通過(guò)處理相關(guān)責(zé)任方達(dá)到預(yù)防事故發(fā)生的目的。 我國(guó)調(diào)查處理船舶污染事故的機(jī)制是建立的一系列法律法規(guī)授權(quán)基礎(chǔ)之上的。用法律手段規(guī)范船舶污染事故調(diào)查處理工作,會(huì)收到良好效果。我國(guó)先后制定了《中華人民共和國(guó)海洋環(huán)境保護(hù)法》、《中華人民共和國(guó)防治船舶污染海洋環(huán)境管理?xiàng)l例》、《中華人民共和國(guó)防治船舶污染內(nèi)河水域環(huán)境管理規(guī)定》、《船舶污染事故調(diào)查官管理規(guī)定(試行)》、《中華人民共和國(guó)海上海事行政處罰規(guī)定》以及即將生效的《船舶污染海洋環(huán)境應(yīng)急防備和應(yīng)急處置管理規(guī)定》等一系列法律法規(guī),規(guī)范了我國(guó)對(duì)船舶污染事故調(diào)查處理機(jī)制。然而我國(guó)在該領(lǐng)域的立法尚不健全,現(xiàn)行船舶污染事故調(diào)查處理法律制度存在不足,導(dǎo)致了船舶污染事故調(diào)查處理目的在思想上不統(tǒng)一,在調(diào)查處理機(jī)制內(nèi)很多地方仍處于法律“真空”狀態(tài)。 本文從船舶污染事故調(diào)查處理的法律性質(zhì)入手,借鑒發(fā)達(dá)國(guó)家的在該領(lǐng)域的運(yùn)行機(jī)制,結(jié)合我國(guó)立法和執(zhí)法現(xiàn)狀,按照行政法一般理論探討船舶污染事故調(diào)查處理機(jī)制,找出該機(jī)制上的不足,并且提出自己的建議。
[Abstract]:With the prosperity of our country ' s economy , more and more ships are required to operate , and the risk of ship pollution accidents is always in existence . A professional investigation and treatment mechanism not only can eliminate the harm brought by the accident itself , but also can make the relevant authorities learn from the accident , improve the investigation mechanism , and deal with the relevant responsible parties to achieve the purpose of preventing accidents .


A series of laws and regulations , such as the Regulations on Environmental Management of the People ' s Republic of China on the Prevention and Control of Pollution by Ships , the Regulations on the Prevention and Control of Marine Pollution Accidents and Emergency Preparedness and Emergency Treatment Management Regulations of the People ' s Republic of China on the Prevention and Control of Pollution Accidents in China have been formulated .


Starting from the legal nature of the investigation and treatment of ship pollution accident , this paper draws on the running mechanism of the developed countries in this field , and discusses the mechanism of investigation and treatment of ship pollution accident according to the general theory of administrative law in the light of the current situation of legislation and law enforcement in China , and puts forward its own suggestions .
