【摘要】：自然資源行政規(guī)劃作為一個國家經(jīng)濟(jì)規(guī)劃或者計劃的重要組成部分,是依據(jù)一個國家或者地區(qū)的自然資源本身的特點(diǎn)以及國民經(jīng)濟(jì)發(fā)展的要求,在一定規(guī)劃期限內(nèi)對管轄區(qū)域內(nèi)各類自然資源的開發(fā)、利用、保護(hù)、恢復(fù)和管理所作的總體安排。其目的是為了從整體上解決自然資源開發(fā)利用與生態(tài)保護(hù)、當(dāng)前利益與長期持續(xù)發(fā)展的矛盾以及資源分配問題,以求用合理的布局和形式開發(fā)利用自然資源,促進(jìn)經(jīng)濟(jì)社會的可持續(xù)發(fā)展。在地球上,自然資源的數(shù)量總是有一個極限,特別是不可再生資源在一定的時間和地區(qū)是有限的,會出現(xiàn)資源枯竭和短缺的問題。隨著人口的增加和人類對自然資源利用范圍的擴(kuò)大,自然資源的稀缺性日益凸現(xiàn)。因此,合理規(guī)劃開發(fā)利用自然資源對人類社會的發(fā)展具有重要而深遠(yuǎn)的歷史意義。這就為社會以法律的手段保障自然資源的可持續(xù)利用提供了最基本的動因。 從制度入手解決我國目前所面對的資源困境,或許是一個很好的突破口。本文所瞄準(zhǔn)的主題正是自然資源的基本制度之一——自然資源行政規(guī)劃制度。文章從行政規(guī)劃基本理論的研究開始,在介紹目前我國自然資源行政規(guī)劃制度的基礎(chǔ)上,初步探析了國外部分國家自然資源相關(guān)的制度。筆者通過對國內(nèi)外自然資源行政規(guī)劃制度的研究,擬對修改和完善我國自然資源行政規(guī)劃制度提出自己的一套嘗試性的建議。
[Abstract]:As an important part of a country's economic planning or plan, the administrative planning of natural resources is based on the characteristics of the natural resources of a country or region and the requirements of national economic development. General arrangement for the development, utilization, protection, restoration and management of natural resources within the jurisdiction within a certain planning period. Its purpose is to solve the contradiction between the exploitation and utilization of natural resources and ecological protection, the contradiction between current interests and long-term sustainable development as well as the problem of resource allocation in order to develop and utilize natural resources in a reasonable layout and form. To promote sustainable economic and social development. On the earth, there is always a limit to the amount of natural resources, especially non-renewable resources are limited in a certain time and region, which will lead to the problem of resource depletion and shortage. With the increase of population and the expansion of the scope of human utilization of natural resources, the scarcity of natural resources is becoming increasingly prominent. Therefore, rational development and utilization of natural resources has important and far-reaching historical significance for the development of human society. This provides the most basic motivation for society to protect the sustainable use of natural resources by means of law. It may be a good breakthrough to solve the resource dilemma of our country from the system. The theme of this paper is one of the basic systems of natural resources-administrative planning system of natural resources. Starting from the study of the basic theory of administrative planning and introducing the current administrative planning system of natural resources in China, this paper preliminarily analyzes the natural resources related systems in some foreign countries. Based on the study of the administrative planning system of natural resources at home and abroad, the author intends to put forward a set of tentative suggestions to modify and perfect the administrative planning system of natural resources in China.
