【摘要】: 循環(huán)經(jīng)濟(jì)是人類社會(huì)為解決經(jīng)濟(jì)發(fā)展中面臨的生存與環(huán)境問(wèn)題,探尋未來(lái)經(jīng)濟(jì)發(fā)展模式的過(guò)程中所形成的新的經(jīng)濟(jì)發(fā)展模式。循環(huán)經(jīng)濟(jì)發(fā)展模式與傳統(tǒng)的線性經(jīng)濟(jì)發(fā)展模式完全不同,它是在保護(hù)和改善環(huán)境的前提下,以高效利用資源為手段,以實(shí)現(xiàn)社會(huì)經(jīng)濟(jì)可持續(xù)發(fā)展為目的,是可持續(xù)發(fā)展戰(zhàn)略理論的進(jìn)一步深化。近年來(lái)我國(guó)社會(huì)經(jīng)濟(jì)增長(zhǎng)處于高速發(fā)展時(shí)期,但我國(guó)經(jīng)濟(jì)發(fā)展經(jīng)歷的卻是“高消耗、低效益、高排放”的粗放式線性經(jīng)濟(jì)增長(zhǎng)方式的歷程,對(duì)生態(tài)環(huán)境的破壞十分嚴(yán)重。因此,保護(hù)環(huán)境、節(jié)約資源成為我國(guó)今后經(jīng)濟(jì)發(fā)展的首要價(jià)值目標(biāo)。 法制是經(jīng)濟(jì)發(fā)展的重要保障,以有效的法制手段來(lái)保障經(jīng)濟(jì)發(fā)展與資源環(huán)境的協(xié)調(diào),促進(jìn)循環(huán)經(jīng)濟(jì)發(fā)展顯得尤為重要。循環(huán)經(jīng)濟(jì)比較發(fā)達(dá)的國(guó)家已將循環(huán)經(jīng)濟(jì)發(fā)展模式以立法的形式確定下來(lái),并建立了比較完整的循環(huán)經(jīng)濟(jì)法制體系。而我國(guó)循環(huán)經(jīng)濟(jì)法制建設(shè)方面還有著諸多問(wèn)題。現(xiàn)存的循環(huán)經(jīng)濟(jì)法律中,法制理念相對(duì)滯后,法律體系不夠完整,缺乏嚴(yán)格的實(shí)施機(jī)制與責(zé)任機(jī)制,政府對(duì)推動(dòng)循環(huán)經(jīng)濟(jì)發(fā)展的宏觀調(diào)控功能發(fā)揮不足等,這些因素都直接影響到循環(huán)經(jīng)濟(jì)法律制度在促進(jìn)循環(huán)經(jīng)濟(jì)發(fā)展中作用的發(fā)揮。本文通過(guò)對(duì)德國(guó)和日本的循環(huán)經(jīng)濟(jì)實(shí)踐及其立法進(jìn)行考證與分析,在總結(jié)我國(guó)循環(huán)經(jīng)濟(jì)法制發(fā)展的基礎(chǔ)上提出:我國(guó)的循環(huán)經(jīng)濟(jì)法制體系的基本框架應(yīng)當(dāng)是以憲法為根本法、以循環(huán)經(jīng)濟(jì)促進(jìn)法和環(huán)境保護(hù)法為基本法、以清潔生產(chǎn)促進(jìn)法等法律為綜合法、以各專項(xiàng)法和規(guī)范性文件為補(bǔ)充的循環(huán)經(jīng)濟(jì)法制體系。在促進(jìn)循環(huán)經(jīng)濟(jì)有效運(yùn)行的社會(huì)保障機(jī)制方面,首先,應(yīng)構(gòu)建完善的立法保障措施。本文提出應(yīng)將循環(huán)經(jīng)濟(jì)的發(fā)展理念補(bǔ)充進(jìn)憲法,作為今后經(jīng)濟(jì)發(fā)展的戰(zhàn)略目標(biāo)在憲法中加以明確規(guī)定;對(duì)其他與循環(huán)經(jīng)濟(jì)發(fā)展有關(guān)的法律法規(guī)進(jìn)行適當(dāng)修改,制定具體的實(shí)施細(xì)則,使法律實(shí)施有具體的標(biāo)準(zhǔn)依據(jù),并根據(jù)循環(huán)經(jīng)濟(jì)的發(fā)展實(shí)踐不斷補(bǔ)充頒布相關(guān)專項(xiàng)法規(guī)。其次,應(yīng)制定全方位的政府制度保障措施。政府在循環(huán)經(jīng)濟(jì)的發(fā)展過(guò)程中起著重要作用,應(yīng)當(dāng)通過(guò)政策調(diào)整的有力手段,從宏觀上調(diào)控循環(huán)經(jīng)濟(jì)的發(fā)展。本文提出了包括循環(huán)經(jīng)濟(jì)規(guī)劃制度、綠色國(guó)民經(jīng)濟(jì)核算制度、循環(huán)經(jīng)濟(jì)評(píng)價(jià)制度、政府優(yōu)先購(gòu)買制度、經(jīng)濟(jì)激勵(lì)制度、科技支持與示范制度、環(huán)境綠色產(chǎn)權(quán)制度及資源有償使用制度在內(nèi)的八項(xiàng)促進(jìn)循環(huán)經(jīng)濟(jì)發(fā)展的制度措施。再次,應(yīng)實(shí)施有效的企業(yè)制度保障措施。企業(yè)是經(jīng)濟(jì)發(fā)展的具體實(shí)施者,循環(huán)經(jīng)濟(jì)的發(fā)展需要企業(yè)的積極參與。本文對(duì)生產(chǎn)者的責(zé)任進(jìn)行了分析與論證,指出生產(chǎn)者應(yīng)當(dāng)對(duì)所生產(chǎn)的產(chǎn)品承擔(dān)延伸責(zé)任,即生產(chǎn)者在其生產(chǎn)的產(chǎn)品被使用、被廢棄以后,仍負(fù)有一定的對(duì)其產(chǎn)品進(jìn)行適當(dāng)?shù)馁Y源循環(huán)利用和處置的責(zé)任,并以此達(dá)到提高生產(chǎn)者的生態(tài)效率,推動(dòng)循環(huán)經(jīng)濟(jì)在生產(chǎn)者層面甚至整個(gè)社會(huì)層面上順利發(fā)展的效果;同時(shí)還提出應(yīng)當(dāng)將社會(huì)中介組織引進(jìn)到環(huán)境與資源管理中來(lái),并使其成為我國(guó)在實(shí)現(xiàn)廢棄物的減量化、無(wú)害化和資源化的循環(huán)經(jīng)濟(jì)發(fā)展目標(biāo)中的輔助機(jī)構(gòu)。第四,應(yīng)推行廣泛的社會(huì)公眾制度保障措施。循環(huán)經(jīng)濟(jì)的發(fā)展不僅要依靠政府的倡導(dǎo)與推進(jìn)和企業(yè)的積極參與,還需要社會(huì)公眾的積極參與,需要充分重視消費(fèi)者個(gè)人在循環(huán)經(jīng)濟(jì)發(fā)展中的重要作用。社會(huì)生產(chǎn)的末端是消費(fèi)者,消費(fèi)者的消費(fèi)行為將導(dǎo)致消費(fèi)結(jié)構(gòu)的重大變化,而消費(fèi)結(jié)構(gòu)的變化必將導(dǎo)致產(chǎn)業(yè)結(jié)構(gòu)、技術(shù)結(jié)構(gòu)和產(chǎn)品結(jié)構(gòu)的變化。因此,對(duì)消費(fèi)行為的引導(dǎo),會(huì)直接影響到社會(huì)經(jīng)濟(jì)的發(fā)展模式。本文在此部分提出,在我國(guó)應(yīng)當(dāng)通過(guò)建立綠色消費(fèi)制度、設(shè)立綠色環(huán)境保護(hù)日等形式,引導(dǎo)消費(fèi)者的消費(fèi)形式,使之樹(shù)立綠色環(huán)保的消費(fèi)理念,從而在社會(huì)公眾層面上推進(jìn)循環(huán)經(jīng)濟(jì)的發(fā)展。
[Abstract]:Circular economy is a new economic development pattern formed in the process of solving the problems of survival and environment faced by human society in solving economic development .



On the basis of summarizing the development of circular economy , this paper puts forward that the basic framework of circular economy legal system should be the basic law of circular economy , the law system is not complete , lack of strict implementation mechanism and responsibility mechanism , and the government plays an important role in promoting the development of circular economy .
This paper analyzes and proves the responsibility of producers , and points out that producers should be responsible for the development of circular economy .
At the same time , it is suggested that the social intermediary organizations should be introduced into the environment and resource management to become the subsidiary organs of our country in the development of the recycling economy which can realize the reduction of the wastes , the innocent and the resources . The development of the circular economy should not only depend on the government ' s initiative and the promotion of the promotion and the active participation of the enterprises , but also the active participation of the public .
