【摘要】：我國環(huán)境資源案件跨區(qū)域集中管轄尚處于探索階段,各地做法不一�，F(xiàn)行主要做法是根據(jù)生態(tài)系統(tǒng)或生態(tài)功能區(qū)、案件性質(zhì)和河流流域、環(huán)境資源案件數(shù)量、人口數(shù)量和經(jīng)濟社會發(fā)展水平等因素確定集中管轄法院,或者依托鐵路法院實現(xiàn)跨區(qū)域集中管轄,實行環(huán)境資源案件"二合一"或"三合一"的審理模式�？鐓^(qū)域集中管轄適度打破了行政區(qū)劃和司法區(qū)劃的重合,具備良好的價值和作用。但在實踐中,存在法律依據(jù)不足、跨區(qū)域程度不高、不方便當事人訴訟、環(huán)境資源刑事案件跨區(qū)域管轄難以落實等問題和局限。要突破現(xiàn)行改革的局限性,應(yīng)將跨區(qū)域集中管轄法定化,調(diào)整集中管轄的層級和地域范圍,同時積極采取措施方便當事人訴訟。
[Abstract]:The cross-regional centralized jurisdiction of environmental resources cases in China is still in the exploration stage. The main current practice is to determine the centralized jurisdiction of courts based on factors such as ecosystems or ecological functional zones, the nature of cases and river basins, the number of cases involving environmental resources, the number of population and the level of economic and social development, etc. Or rely on the railway court to realize the centralized jurisdiction over different regions and carry out the trial mode of "two in one" or "three in one" in environmental and resource cases. Cross-regional centralized jurisdiction breaks the overlap of administrative division and judicial division and has good value and function. However, in practice, there are some problems and limitations, such as insufficient legal basis, low cross-regional degree, inconvenient litigant action, and difficult implementation of cross-regional jurisdiction of environmental and resource criminal cases. In order to break through the limitation of current reform, we should legalize centralized jurisdiction across regions, adjust the level and regional scope of centralized jurisdiction, and take active measures to facilitate litigants' litigation.
