我國生物質(zhì)能立法研究論綱

【摘要】:生物質(zhì)能的發(fā)展不僅僅是技術(shù)層面的問題,更需要法律的促進(jìn)和保障。以法律促進(jìn)生物質(zhì)能的發(fā)展,是法治社會(huì)的應(yīng)有之義和必然要求。在現(xiàn)階段,我國對(duì)生物質(zhì)能的立法還處于起步階段,對(duì)生物質(zhì)能的相關(guān)規(guī)定分散于一些規(guī)范性法律文件當(dāng)中,這些規(guī)定都是一些原則性的規(guī)定,缺乏可操作性,不能滿足生物質(zhì)能快速發(fā)展的需要。當(dāng)前,我國沒有一部專門針對(duì)生物質(zhì)能的立法,生物質(zhì)能立法的缺失,使得生物質(zhì)能沒有納入到法律保護(hù)軌道之中,不利于生物質(zhì)能長遠(yuǎn)、健康、穩(wěn)定的發(fā)展。 從長遠(yuǎn)來看,生物質(zhì)能立法是可再生能源法律體系中必不可少的組成部分,是應(yīng)對(duì)能源短缺和能源環(huán)境問題的戰(zhàn)略選擇。生物質(zhì)能立法有其必要性,加之生物技術(shù)的發(fā)展為生物質(zhì)能立法提供技術(shù)支撐,以及國外生物質(zhì)能成功的立法經(jīng)驗(yàn)可以借鑒,使得生物質(zhì)能立法具有現(xiàn)實(shí)性。我國經(jīng)濟(jì)社會(huì)的發(fā)展一直遵循可持續(xù)發(fā)展理論,可再生能源的發(fā)展與可持續(xù)發(fā)展的內(nèi)涵具有一致性,生物質(zhì)能的發(fā)展正是可持續(xù)發(fā)展理念在可再生能源領(lǐng)域的實(shí)踐。為應(yīng)對(duì)氣候變化,減少溫室氣體的排放,建設(shè)低碳社會(huì)是我國經(jīng)濟(jì)社會(huì)轉(zhuǎn)型的必然要求,發(fā)展循環(huán)經(jīng)濟(jì)是建設(shè)低碳社會(huì)的方式之一。發(fā)展生物質(zhì)能,加快對(duì)生物質(zhì)能的開發(fā)利用對(duì)建設(shè)低碳型社會(huì)和發(fā)展循環(huán)經(jīng)濟(jì)都是有效的方式之一 我國對(duì)生物質(zhì)能立法模式的選擇應(yīng)當(dāng)考慮我國的國情和生物質(zhì)能發(fā)展的具體情況,與我國現(xiàn)有的立法體系相統(tǒng)一。立法模式的選擇受多種因素的影響,我國生物質(zhì)能立法模式應(yīng)當(dāng)在現(xiàn)有可再生能源法律體系基礎(chǔ)之上實(shí)行混合立法的模式,并適當(dāng)借鑒國外生物質(zhì)能成功的立法經(jīng)驗(yàn)。生物質(zhì)能立法作為指導(dǎo)生物質(zhì)能發(fā)展的重要立法,應(yīng)當(dāng)在立法過程中始終貫徹一些重要的立法原則,保持立法的統(tǒng)一性和可操作性。生物質(zhì)能制度供給,是生物質(zhì)能立法中促進(jìn)生物質(zhì)能發(fā)展的具體應(yīng)用,這些制度與生物質(zhì)能的其它措施配套使用,能夠更好地發(fā)揮立法的促進(jìn)作用。生物質(zhì)能作為新型可再生能源,需要國家加大投入力度,在稅收、資金和政策上給予支持。
[Abstract]:The development of biomass energy is not only a technical issue, but also needs the promotion and protection of law. It is necessary and necessary to promote the development of biomass energy by law. At the present stage, the legislation on biomass energy in our country is still in its infancy, and the relevant provisions on biomass energy are scattered in some normative legal documents. These provisions are all provisions of principle and lack of maneuverability. Can not meet the rapid development of biomass energy needs. At present, our country does not have a special legislation for biomass energy, the lack of biomass energy legislation, so that biomass energy has not been brought into the track of legal protection, is not conducive to the long-term, healthy and stable development of biomass energy. In the long run, biomass energy legislation is an indispensable part of the legal system of renewable energy and a strategic choice to deal with energy shortage and energy environment problems. Biomass energy legislation has its necessity, in addition, the development of biotechnology provides technical support for biomass energy legislation, and the successful legislative experience of foreign biomass energy can be used for reference, which makes biomass energy legislation realistic. The development of economy and society in China has always followed the theory of sustainable development. The development of renewable energy is consistent with the connotation of sustainable development. The development of biomass energy is the practice of the concept of sustainable development in the field of renewable energy. In order to cope with climate change and reduce greenhouse gas emissions, building a low-carbon society is an inevitable requirement of economic and social transformation in China, and developing circular economy is one of the ways to build a low-carbon society. Developing biomass energy and speeding up exploitation and utilization of biomass energy are one of the effective ways to build low-carbon society and develop circular economy. The choice of legislation mode of biomass energy in our country should consider the situation of our country and the specific situation of the development of biomass energy, and be unified with the existing legislation system of our country. The choice of legislation mode is influenced by many factors. The model of biomass energy legislation in our country should be based on the existing legal system of renewable energy to implement the mixed legislation model, and draw on the successful legislative experience of foreign biomass energy. As an important legislation to guide the development of biomass energy, biomass energy legislation should always carry out some important legislative principles in the legislative process, and maintain the unity and maneuverability of legislation. The supply of biomass energy system is the concrete application to promote the development of biomass energy in the legislation of biomass energy. These systems can be used in conjunction with other measures of biomass energy, which can play a better role in promoting legislation. As a new type of renewable energy, biomass energy needs the support of the government in tax, fund and policy.
