【摘要】：我國現(xiàn)行《中華人民共和國環(huán)境保護(hù)法》(以下簡稱《環(huán)境保護(hù)法》)修訂于1989年,它確立了我國環(huán)境保護(hù)法律體系的基本框架,推動了國家和地方的環(huán)境立法工作以及國家各項環(huán)境保護(hù)單行法律法規(guī)的制定。不可否認(rèn),這部法律曾在我國的環(huán)境保護(hù)工作中發(fā)揮過重要的作用。這部法律從頒布至今,已經(jīng)走過了二十多個年頭。二十多年來我國的國家形勢發(fā)生了重大的變化,已經(jīng)實現(xiàn)由計劃經(jīng)濟(jì)向市場經(jīng)濟(jì)的轉(zhuǎn)變,國家經(jīng)濟(jì)迅速發(fā)展,人民生活水平顯著提高,環(huán)境形勢也發(fā)生了重大變化,很多同時期的其他環(huán)境保護(hù)單行法律被修訂,同時也制定了多部新的環(huán)境保護(hù)單行法律�！董h(huán)境保護(hù)法》已經(jīng)不能與整個環(huán)境法律體系相適應(yīng),不能符合科學(xué)發(fā)展觀的要求。《環(huán)境保護(hù)法》的完善已成為當(dāng)務(wù)之急,對其進(jìn)行研究,具有十分重要的理論意義和現(xiàn)實意義。 本文回顧了當(dāng)代中國環(huán)境法的演變與發(fā)展,從總體上把握中國環(huán)境法的變遷過程,論證了科學(xué)發(fā)展觀指導(dǎo)《環(huán)境保護(hù)法》完善的可行性,從立法指導(dǎo)思想、立法層次、基本原則、基本制度和環(huán)境權(quán)等方面深入探討分析了目前我國《環(huán)境保護(hù)法》中存在的一些問題,對比研究了部分國家和地區(qū)的環(huán)境保護(hù)基本法,并在此基礎(chǔ)上有針對性地提出了一系列完善我國《環(huán)境保護(hù)法》的建議：以科學(xué)發(fā)展觀作為立法指導(dǎo)思想,提高立法層次；調(diào)整“環(huán)境保護(hù)同經(jīng)濟(jì)、社會發(fā)展相協(xié)調(diào)”原則為“環(huán)境保護(hù)同經(jīng)濟(jì)、社會可持續(xù)發(fā)展”原則,調(diào)整“預(yù)防為主、防治結(jié)合、綜合治理”原則為“污染源頭預(yù)防為主、防治結(jié)合、綜合治理”原則,“環(huán)境責(zé)任”原則中應(yīng)當(dāng)增加“政府對環(huán)境負(fù)責(zé)”的內(nèi)容,增加協(xié)作原則,使《環(huán)境保護(hù)法》基本原則更加符合科學(xué)發(fā)展觀；完善環(huán)境影響評價制度、“三同時”制度、排污收費制度和限期治理制度,并建立清潔生產(chǎn)制度、淘汰制度、增加環(huán)保投入制度和突發(fā)環(huán)境事故應(yīng)急制度這些新的制度；確立并完善公民的環(huán)境權(quán)。 本文旨在讓我國《環(huán)境保護(hù)法》真正成為以科學(xué)發(fā)展觀為指導(dǎo)思想的,由人大制定的高位階的,基本原則和基本制度更合理的,環(huán)境權(quán)更完善的,更加符合我國國情的,真正意義上的環(huán)境保護(hù)基本法,以期對我國環(huán)境法制建設(shè)和環(huán)境問題的改善有所裨益。
[Abstract]:The current Environmental Protection Law of the people's Republic of China (hereinafter referred to as "Environmental Protection Law") was amended in 1989. It establishes the basic framework of the legal system of environmental protection in China.Promote the national and local environmental legislation and national environmental protection laws and regulations.Undeniably, this law has played an important role in environmental protection in China.The law has gone through more than 20 years since it was promulgated.Over the past two decades and more, major changes have taken place in the national situation in our country, with the transition from a planned economy to a market economy, the rapid development of the national economy, the remarkable improvement in the living standards of the people, and major changes in the environmental situation.Many other environmental laws of the same period have been amended, and many new laws on environmental protection have been enacted. The Environmental Protection Act is no longer compatible with the entire environmental legal system.The perfection of the Environmental Protection Law has become an urgent matter. It is of great theoretical and practical significance to study it.This paper reviews the evolution and development of contemporary Chinese environmental law, grasps the vicissitude process of Chinese environmental law on the whole, and proves the feasibility of guiding the perfection of "Environmental Protection Law" by the scientific development view, from the legislative guiding ideology and the legislative level.The basic principles, basic systems and environmental rights are discussed and analyzed in depth, and some problems existing in the Environmental Protection Law of our country are analyzed, and the basic laws of environmental protection in some countries and regions are comparatively studied.On this basis, a series of suggestions are put forward to perfect the Environmental Protection Law of our country: to take the scientific development view as the guiding ideology of legislation, to raise the legislative level, to adjust the relationship between environmental protection and economy,The principle of coordinating social development is the principle of "environmental protection, economic and social sustainable development", and the principle of adjusting the principle of "prevention first, combination of prevention and control, comprehensive management" is the principle of "prevention of pollution at source, combination of prevention and control".In the principle of "environmental responsibility", the contents of "government responsibility for the environment" should be added, and the principle of cooperation should be added to make the basic principles of the Environmental Protection Law more in line with the scientific concept of development, and the system of environmental impact assessment should be improved, and the system of "three simultaneous" should be improved.The new system of sewage charge system and deadline treatment system, the establishment of cleaner production system, the elimination system, the increase of environmental protection input system and the emergency system of environmental accident, the establishment and improvement of citizens' environmental rights.The purpose of this paper is to make the Environmental Protection Law of our country become more reasonable in basic principles and systems, more perfect in environmental rights and more in line with the national conditions of our country, with the scientific development view as the guiding ideology, the basic principles and the basic system being more reasonable, and the people's Congress as the guiding ideology.The basic law of environmental protection in real sense is expected to benefit the construction of environmental legal system and the improvement of environmental problems in China.
