【摘要】： 作為地球上一切生命生存所需的支持系統(tǒng),土壤生態(tài)環(huán)境系統(tǒng)具有著特別重要的意義。然而,近年來經(jīng)濟(jì)迅速發(fā)展使得我國土壤生態(tài)環(huán)境業(yè)已面臨嚴(yán)重的威脅。因?yàn)橥寥牢廴揪哂泻芏嗖煌谄渌匚廴镜闹饕卣?也有著其他環(huán)境元素污染來源的主要形式,這就決定了在土壤污染的防治方面需要很多特殊的方法和制度。 土壤污染的防治已經(jīng)成為一個(gè)世界性課題,引起了世界上大多數(shù)國家的重視,特別是在法律方面的規(guī)制也愈加完善。在多年治理環(huán)境污染的經(jīng)驗(yàn)基礎(chǔ)之上,美國等發(fā)達(dá)國家已經(jīng)建立了相對比較合理的土壤污染防治法律體系,在世界范圍內(nèi)樹立了土壤污染防治的成功范例,較好的運(yùn)用了行政管理為主、經(jīng)濟(jì)刺激為輔、公眾參與為補(bǔ)充的土壤污染防治的綜合管理法律體系。本文在結(jié)合國內(nèi)外的法律實(shí)踐,探究了土壤污染治理的法學(xué)基本原理,指出了國家責(zé)任理論、污染者負(fù)擔(dān)理論、環(huán)境正義理論和環(huán)境安全理論是土壤污染防治的法律理論依據(jù)。同時(shí),本文介紹了美國先進(jìn)的土壤污染防治法律制度的構(gòu)建和棕地治理再開發(fā)、再利用的法律的演變過程,探尋其先進(jìn)的法律意義,為我國土壤污染防治法律制度的構(gòu)建提供了借鑒意義。 目前,我國的土壤污染防治法律制度已經(jīng)有了初步的架構(gòu),但是遠(yuǎn)遠(yuǎn)不能應(yīng)對日益嚴(yán)峻的土壤污染形勢。響應(yīng)國內(nèi)著名環(huán)境法學(xué)者的號召,本人指出應(yīng)該盡快制定一部土壤污染防治基本法以對我國的土壤污染狀況的改善作出法律上的體系化安排。在這部法律中,我們首先應(yīng)該明確其立法的目的和指導(dǎo)思想,確定可持續(xù)發(fā)展的立法理念。其次,應(yīng)該確立嚴(yán)格的管理制度體系和責(zé)任追究制度。最后,應(yīng)該完善環(huán)境保護(hù)的信息公開制度和公眾參與制度。
[Abstract]:As a supporting system for the survival of all life on earth, the soil ecological system is of particular importance. However, In recent years, the rapid development of economy has made the soil ecological environment of our country face serious threat, because soil pollution has many main characteristics which are different from other elements pollution, but also has the main form of other environmental elements pollution source. This determines that the prevention and control of soil pollution needs a lot of special methods and systems. The prevention and control of soil pollution has become a worldwide issue, which has attracted the attention of most countries in the world, especially in the legal aspects of regulation is increasingly perfect. On the basis of many years of experience in environmental pollution control, The United States and other developed countries have established a relatively reasonable legal system for the prevention and control of soil pollution. They have set up a successful example of soil pollution prevention and control around the world. Based on the legal practice at home and abroad, this paper probes into the basic principles of the law of soil pollution control, and points out the theory of national responsibility, the theory of polluter's burden, and the legal system of comprehensive management of soil pollution, which is supplemented by public participation. The theory of environmental justice and the theory of environmental security are the legal theoretical basis of soil pollution prevention and control. At the same time, this paper introduces the construction of the advanced legal system of soil pollution prevention and control in the United States and the evolution of the law of redeveloping and reusing the brown land. Exploring its advanced legal significance provides a reference for the construction of the legal system of soil pollution prevention and control in China. At present, the legal system of soil pollution prevention and control in China has a preliminary framework, but it is far from being able to cope with the increasingly serious situation of soil pollution. I pointed out that a basic law on the prevention and control of soil pollution should be formulated as soon as possible in order to make legal systematization arrangements for the improvement of the situation of soil pollution in China. In this law, we should first clarify the purpose and guiding ideology of its legislation. Secondly, we should establish strict management system and accountability system. Finally, we should perfect the information disclosure system and public participation system of environmental protection.
