【摘要】：目前我國自然風(fēng)景資源行政管理體制呈現(xiàn)出"兩線多級"的特點(diǎn)。自然風(fēng)景資源管理機(jī)構(gòu)作為政府主管部門的派出機(jī)構(gòu),不具有獨(dú)立的法人地位,無法行使自然風(fēng)景資源的所有權(quán)。為了擺脫現(xiàn)有困境,必須實(shí)現(xiàn)自然風(fēng)景資源管理機(jī)構(gòu)的法人化,明確自然風(fēng)景資源的權(quán)利主體和責(zé)任主體,提高管理效率,以更好地實(shí)現(xiàn)對自然風(fēng)景資源的利用和保護(hù)�；趯τ蛲鈬夜珗@的考察,對公益性法人制度以及我國事業(yè)單位改革經(jīng)驗(yàn)的借鑒,具體的制度構(gòu)建應(yīng)該以確立法人財(cái)產(chǎn)權(quán)為基礎(chǔ),以完善法人治理規(guī)則為支撐,以專門立法為保障,從而最終推動我國自然風(fēng)景資源管理機(jī)構(gòu)法人化的改革。
[Abstract]:At present, the administrative management system of natural scenery resources in our country is characterized by "two lines and multiple levels". As a branch of the government in charge, the natural scenery resources management institutions do not have the status of independent legal persons. In order to get rid of the existing predicament, it is necessary to realize the legalization of the natural scenery resource management organization, to make clear the subject of right and responsibility of the natural scenery resource, and to improve the management efficiency. In order to better realize the utilization and protection of the natural scenery resources. Based on the investigation of the extraterritorial national parks, it can be used for reference to the public welfare legal person system and the reform experience of our country's public institutions. The concrete system construction should be based on establishing the property right of legal person, on the basis of perfecting the rules of corporate governance, and on the guarantee of special legislation, so as to promote the reform of legalization of natural scenery resources management organization in China.
