【摘要】： 我國電子廢物數(shù)量大、增長速度快,已經(jīng)成為了一個不可忽視的問題。本案通過對貴嶼電子廢物回收處理現(xiàn)狀的分析,認識到它具有潛在危害性、資源性等特點,與其他固體廢物有著不同之處,若對其進行合理的回收利用和環(huán)保處理,不僅可以保護環(huán)境,而且可以節(jié)約資源,這符合我國走可持續(xù)發(fā)展道路、建立環(huán)境友好型、資源節(jié)約型社會的要求。研究和制定電子棄廢物法律,可以把電子廢棄物問題納入法制軌道,有利于實現(xiàn)對電子廢棄物的合理回收利用和環(huán)保處置。 本文一共分為四個部分,第一部分是案例介紹。在這部分,介紹了貴嶼鎮(zhèn)電子廢棄物的現(xiàn)狀、特點,并對電子廢物的回收處理所涉及的法律焦點進行了分析,闡明了電子廢物的回收利用和環(huán)保處置關(guān)系到我國政府相關(guān)部門的職責和立法。第二部分是對貴嶼鎮(zhèn)電子廢物問題進行法理分析。在這部分,結(jié)合我國的實際情況,分析了我國電子廢物回收處理現(xiàn)狀、電子廢棄物管理現(xiàn)狀。我國電子廢棄物回收處理的管理落后,回收處理處于低水平的狀態(tài),需要得到提升和改善。第三部分是部分發(fā)達國家電子廢棄物法律制度。發(fā)達國家在電子廢物棄管理上積累了一些成熟的經(jīng)驗,值得我們學(xué)習(xí)和借鑒。第四部分是對貴嶼電子廢物的回收處理的對策,是本文的重點內(nèi)容、主要創(chuàng)新之處、我國電子廢棄物立法研究的關(guān)鍵所在。擴大生產(chǎn)者責任是電子廢棄物立法中的重點內(nèi)容,并提出了一些具體的法律制度的構(gòu)想,包括規(guī)范二手市場制度、完善相關(guān)法律、培育電子廢棄物回收處理的市場機制、行政監(jiān)管制度等。
[Abstract]:The large quantity and rapid growth rate of electronic waste in China has become a problem that can not be ignored. Through the analysis of the current situation of recycling and disposal of electronic waste in Guiyu, we have realized that it has the characteristics of potential harmfulness, resource, and so on. It is different from other solid wastes. If it is recycled and treated reasonably, it can not only protect the environment, but also save resources. This is in line with the sustainable development path and the establishment of environment-friendly type in our country. The research and formulation of the law of electronic waste disposal can bring the problem of electronic waste into the legal orbit, which is helpful to realize the rational recycling of electronic waste and the disposal of environmental protection. This paper is divided into four parts, the first part is a case introduction. In this part, it introduces the current situation and characteristics of electronic waste in Guiyu Town, and analyzes the legal focus of the recycling and disposal of electronic waste. This paper expounds that the recycling and environmental protection of electronic waste is related to the responsibilities and legislation of the relevant departments of our government. The second part is the legal analysis of the problem of electronic waste in Guiyu Town. In this part, combined with the actual situation in our country, This paper analyzes the current situation of electronic waste recovery and disposal in China, the current situation of electronic waste management, the backward management of electronic waste recovery and treatment in our country, and the low level of recycling treatment in China. The third part is the legal system of e-waste in some developed countries. Developed countries have accumulated some mature experience in e-waste management. The fourth part is the countermeasures of recycling and disposal of electronic waste in Guiyu, which is the key content of this paper and the main innovation. Expanding producer responsibility is the key content of electronic waste legislation, and puts forward some ideas of specific legal system, including standardizing second-hand market system, perfecting relevant laws, Cultivate the market mechanism of electronic waste recovery and disposal, administrative supervision system and so on.
