【摘要】： 土地作為一種有限的不可再生資源,不但是動植物生命的支持系統(tǒng),還是固液態(tài)廢物的堆放地和人居住及活動的基礎(chǔ),對動植物繁衍和人類生存發(fā)揮著重要的作用。但是在人類工業(yè)化進程中,土地遭受著來自農(nóng)藥、化肥、固體廢棄物等各方面的污染,造成了嚴重的生態(tài)破壞和經(jīng)濟損失。土地污染已成為一個世界性的環(huán)境問題,早在1877年,日本櫪木縣就發(fā)生了足尾銅礦山公害事件,20世紀60年代,發(fā)達國家如美國、荷蘭又因為化學(xué)廢棄物的傾倒導(dǎo)致嚴重的土地污染。隨著污染土地的逐漸擴大和危害的日益嚴重,發(fā)達國家紛紛制定了農(nóng)業(yè)法律和相關(guān)的土地保護法規(guī),采取相應(yīng)的防治措施。經(jīng)過多年的實踐,他們已建立了相對完善的法律體系,有效的遏制了土地污染現(xiàn)象,也為我們提供了許多參考和借鑒。近年來,隨著我國工業(yè)化和城市化進程的快速發(fā)展,人類活動產(chǎn)生大量的污染物進入土地,使我國受污染土地不斷增多,從農(nóng)業(yè)用地逐漸蔓延到工業(yè)用地,成為我國經(jīng)濟社會可持續(xù)發(fā)展的制約因素。這引起了社會的普遍關(guān)注,也為環(huán)境法提供了新的研究熱點�；诖�,本文以我國的土地污染為切入點,對其防治的法律機制做相關(guān)研究和探討。 本文共分三章進行論述:第一章對我國土地污染的基本概念及現(xiàn)狀、特點、危害、原因等基本情況進行了闡述;第二章介紹和分析了國內(nèi)外有關(guān)土地污染防治的法律規(guī)定,并重點對中美兩國的法律規(guī)定進行了比較;第三章是文章的主體部分,對我國土地污染防治法律制度的構(gòu)建提出了設(shè)想,尤其是對土地污染防治的立法建議和亟待確立的重要法律原則進行了思考。 本文認為,在我國進行土地污染防治立法是必要的,也是可行的。只有構(gòu)建了完善的法律體系,才能有效地遏制目前土地污染不斷惡化的趨勢,為我國經(jīng)濟、社會的可持續(xù)發(fā)展提供不竭的動力。
[Abstract]:As a limited non-renewable resource, land is not only a support system for animal and plant life, but also a foundation for the storage of solid and liquid wastes and for human habitation and activities. It plays an important role in animal and plant reproduction and human survival. But in the process of human industrialization, the land is polluted by pesticides, fertilizers, solid wastes, etc. Land pollution has become a worldwide environmental problem. As early as 1877, the pollution incident of Fuwei Copper Mine occurred in Tochigi Prefecture, Japan on 60s, and developed countries such as the United States. The Netherlands also caused serious land pollution because of the dumping of chemical waste. With the gradual expansion of polluted land and the increasing harm to it, developed countries have formulated agricultural laws and related land protection regulations one after another. After many years of practice, they have established a relatively perfect legal system, effectively curbed the phenomenon of land pollution, and provided us with many references and references in recent years. With the rapid development of industrialization and urbanization in our country, human activities produce a large number of pollutants into the land, which make the polluted land in our country increase, and gradually spread from agricultural land to industrial land. This has aroused the general concern of the society and provided a new research hotspot for the environmental law. Based on this, this paper takes the land pollution of our country as the starting point. To its prevention and cure of the legal mechanism to do relevant research and discussion. This paper is divided into three chapters: the first chapter describes the basic concepts, characteristics, hazards, causes and other basic conditions of land pollution in China, the second chapter introduces and analyzes the laws and regulations of land pollution prevention and control at home and abroad. The third chapter is the main part of the article, the construction of the legal system of the prevention and control of land pollution in China is proposed. In particular, the legislative suggestions and important legal principles for land pollution prevention and control are considered. This paper holds that it is necessary and feasible to legislate on land pollution prevention and control in our country. Only by constructing a perfect legal system, can we effectively curb the worsening trend of land pollution in China. The sustainable development of society provides inexhaustible power.
