    前言：介紹調(diào)整論的主要內(nèi)容,闡明法律應不應該、能不能夠以及如何調(diào)整人與自然關(guān)系這三個層次的問題,概括了調(diào)整論對主流法理學補充的四個要點,以及對主流法理學進行反思與挑戰(zhàn)的四個基本理論領(lǐng)域。認為法律人是作為人與人的關(guān)系和人與自然的關(guān)系的總和的人;每個人只能通過自身與其他人的關(guān)系和自身與自然(環(huán)境資源)的關(guān)系求生存、求發(fā)展、求利益、求幸福;個人通過其行為建立和變革人與人的關(guān)系和人與自然的關(guān)系,法律既可以規(guī)定人對人的行為,也可以規(guī)定人對自然物的行為,因而法律既能夠調(diào)整人與人的關(guān)系,也能夠調(diào)整人與自然的關(guān)系。環(huán)境資源法對人與自然關(guān)系的調(diào)整,是指環(huán)境資源法根據(jù)社會經(jīng)濟規(guī)律和自然生態(tài)規(guī)律．根據(jù)人與自然關(guān)系的不同類型、特點和社會需要,設立相應的權(quán)利、義務、規(guī)則和制度去調(diào)整人與自然的關(guān)系。環(huán)境資源法對人與自然關(guān)系的調(diào)整,是一個漸進的、不斷發(fā)展的過程,應該與時俱進。環(huán)境資源法調(diào)整人與自然關(guān)系的機制包括其他法律部門的相關(guān)調(diào)整機制和環(huán)境資源專門法所特有的調(diào)整機制即生態(tài)化調(diào)整機制。
    This paper presents the main content of the Regulation Theory; It clarify three levels of problems that whether law should or not regulate, whether law can or not regulate and how law regulate the relations between man and nature; It also generalize the four points of the Regulation Theory that supplemented to the mainstream jurisprudence, as well as the four basic fields of the Regulation Theory that rethought and challenged to the mainstream jurisprudence.
