【摘要】：近年來，林權流轉市場已經初具規(guī)模，但仍然處于初級階段，無論從林權流轉法規(guī)內容還是實踐中林權流轉市場化都存在著種種問題。 本文以森林資源的經濟價值為出發(fā)點展開論述，認為林權流轉中存在的問題根源是森林資源的經濟價值和生態(tài)價值無法兼顧。林權流轉重在經濟價值的最大化配置，但是從現行的法律規(guī)范內容上看，有關林權流轉的相關規(guī)定并不完善，，森林資源的經濟價值法律地位不明確，進而與林權流轉相關的配套法律制度也相對缺乏。從實踐中看，森林資源的經濟價值和生態(tài)價值的沖突轉化為政府與林農等主體的利益沖突，林農追求經濟利益最大化的目的與政府建設生態(tài)工程，抑制林木砍伐呈現出鮮明的對比。加之林權流轉的配套設施不完備，行政執(zhí)法質量不高導致林權流轉市場呈現低迷局面。 因此，本文通過對林權流轉法律制度理論的分析，在參考大量文獻的基礎上，提出解決對策，完善林權流轉的相關法律規(guī)定，消除流轉市場的法律風險，力求在維護森林資源生態(tài)效能的基礎上，實現其經濟價值的最優(yōu)化配置，為林權流轉市場的穩(wěn)步發(fā)展添磚加瓦。
[Abstract]:In recent years, the market of forest right circulation has taken shape, but it is still in the primary stage. There are all kinds of problems in both the content of the law and the practice of the circulation of forest right. Based on the discussion of the economic value of forest resources, this paper points out that the root of the problems in the circulation of forest rights is that the economic value and ecological value of forest resources can not be taken into account, and that the transfer of forest rights is focused on maximizing the allocation of economic value. However, in terms of the content of the current legal norms, the relevant provisions on the circulation of forest rights are not perfect, the legal status of the economic value of forest resources is not clear, and the supporting legal system related to the circulation of forest rights is also relatively lacking. The conflict between the economic value and ecological value of forest resources is transformed into the conflict of interests between the government and the main bodies such as forest farmers. Forest farmers pursue the goal of maximizing economic interests and the government builds ecological projects. The suppression of deforestation presents a sharp contrast. In addition, the lack of supporting facilities for the transfer of forest rights and the poor quality of administrative law enforcement lead to a downturn in the market for the circulation of forest rights. Therefore, through the analysis of the theory of the legal system of forest property right circulation, based on a large number of references, this paper puts forward some countermeasures to improve the relevant legal provisions of forest property right circulation and eliminate the legal risks of the circulation market. On the basis of maintaining the ecological efficiency of forest resources, the optimal allocation of its economic value can be realized so as to contribute to the steady development of the forest rights circulation market.
